RESOLUTION NO. 17 SERIES 2009 A RESOLUTION APPROVING A REQUEST FOR A SPECIAL REVIEW USE TO ALLOW AN OUTSIDE PATIO DINING AREA AT THE ENTRANCE OF AN EXISTING RESTAURANT (BEEF O'BRADY'S), LOCATED AT 585 EAST SOUTH BOULDER ROAD. WHEREAS, there has been submitted to the Louisville City Council, a request for approval of a special review use to allow for an outside patio dining area at the entrance of an existing restaurant (Beef O'Brady's), located at 585 East South Boulder Road; and WHEREAS, all materials related to the a Special Review Use have been reviewed by City Staff and the Planning Commission and found., to be in compliance with the Louisville zoning ordinances, the Commercial Development Design Standards and Guidelines, related policies and previous approvals; and WHEREAS, after a duly noticed public hearing concerning said Special Review Use on April 16, 2009, where evidence and testimony were entered into the public record, including the staff report dated April 16, 2009, the Planning Commission recommended approval to the City Council, with the following condition: 1. This SRU is granted to the applicant only and may not be exchanged at time of sale; and WHEREAS, City Council has reviewed the application, including the recommendation of the Planning Commission and that the application should be approved, with the following condition: 1. This SRU is granted to the applicant only and may not be exchanged at time of sale; and NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of Louisville, Colorado does hereby approve a Special Review Use (SRU) to allow for an outside patio dining area at the entrance of an existing restaurant (Beef O'Brady's), located at 585 East South Boulder Road, with the above condition.
