<br />ORDINANCE NO. 1549 <br />SERIES .2009 <br /> <br />AN ORDINANCE AMENDING SECTION 2.64.020 OF THE LOUISVILLE MUNICIPAL <br />CODE REGARDING APPOINTMENTS TO THE LOUISVILLE LIBRARY BOARD OF <br />TRUSTEES <br /> <br />WHEREAS, Section 2.64.020 of the Louisville Municipal Code currently provides that <br />appointees to the Louisville Library Board of Trustees shall be residents of the City; and <br /> <br />WHEREAS, the City of Louisville has entered into an Intergovernmental Agreement with <br />the Town of Superior to address contributions by Superior for the operating costs for library <br />facilities and services provided by Louisville, as well as options for resolving issues concerning <br />long-term access to library services for residents of Superior; and <br /> <br />WHEREAS, in furtherance of such Intergovernmental Agreement and as authorized by <br />c.R.S. 924-90-108, the City Council desires to amend Section 2.64.020 of the Louisville Municipal <br />Code to allow for appointment of one resident of Superior to the Louisville Library Board of <br />Trustees; <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br />Section 1. Section 2.64.020 of the Louisville Municipal Code is hereby amended to <br />read as follows (words added are underlined; words deleted are stricken through): <br /> <br />Sec. 2.64.020. Board of trustees--Appointment. <br /> <br />The mayor, with the consent of the city council, shall appoint a board of <br />trustees to manage and control the public library of the city. The board of trustees <br />shall consist of StWefl:six residents of the city and one resident of the Town of <br />Superior recommended by the Town of Superior Board of Trustees. Trustees <br />shall be appointed to serve for five years. Vacancies shall be filled for unexpired <br />terms as soon as possible by the mayor, with the consent of the city council. The <br />board of trustees shall not receive any salary or other compensation for services as <br />trustees, but the necessary travel and subsistence expenses shall be paid from the <br />library fund. <br /> <br />Section 2. If any portion of this ordinance is held to be invalid for any reason, such <br />decisions shall not affect the validity of the remaining portions of this ordinance. The City <br />Council hereby declares that it would have passed this ordinance and each part hereof <br />irrespective ofthe fact that anyone part be declared invalid. <br /> <br />Section 3. All other ordinances or portions thereof inconsistent or conflicting with <br />this ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or <br />conflict. <br />
