AUTUMN RIDGE PARTNERSHIPS - WATER RIGHTS Councilman Leary Councilman Fauson APPROVAL TO PURCHASE WATER RIGHTS ACCEPTANCE OF THE CITY ADMINISTRATOR'S REPORT 11/3/83 Page -20- Councilmembers had a copy of the sale agree- ment; request was for Mayor and Clerk to sign the agreement to acquire the water rights. Commented that he was willing to grant the purchase on the contingency that Lafayette be contacted and make certain that we are not creating another argument with them~ since Autumn Ridge will be a part of Lafayette. Stated that he had discussed this with Ad- ministrator Wurl and it was his feeling that Lafayette wasn't interested in these water rights, but felt that this should be confirmed. Administrator Wurl stated that he told Coun- cilman Leary that he heard a rumor that they were not acquiring Davidson Ditch or Goodhue water rights because they don't have the container our City does to transfer it into Marshall Lake; therefore they can't handle any of it at the time it comes down. Secondly, he felt that Lafayette wanted these shares, they would have made arrangements to get them when they annexed the property. But would contact Lafayette and confirm this. Commented that he did not favor our City contacting anyone with respect to water rights as it would increase the price of the shares and impair our negotiations. Councilman Leary felt fairly certain that Lafayette was not interested in these water shares and still favored the phone call to Lafayette. He did not feel these shares were exmtremely valuable; therefore could not see us alieninating each other any more because of water issues. Councilman Leary moved, Councilwoman Morris seconded that the Mayor and Clerk be authorized to sign the Autumn Ridge Partnerships water sale agreement contingent on the City Adminis- trator contacting the City of Lafayette of our intention to purchase the water. Question called for. All in favor. Motion carried unanimously. Councilman Fauson moved, Mayor Meier seconded that the City Administrator's report be accepted and placed on file. Question called for. All in favor. Motion carried.
