<br />Director Rupp <br /> <br />Councilman Ferrera <br /> <br />Question Called on the Amend- <br />ments <br /> <br />\vTE ON ORDINANCE #794 <br /> <br />Councilman Cussen <br /> <br />Attorney Rautenstraus <br /> <br />VOTE ON ADOPTION OF ORDINANCE <br />#749 <br /> <br />5/18/83 <br /> <br />Page -23- <br /> <br />Advised, presently the City did not have an <br />ordinance that zones property open space. <br />We have to develop a zone specifically for <br />open space or develop or assign with the <br />agricultural zoning district elimination <br />of all uses on the site other than open space. <br />Councilman Ferrera then inquired if the City <br />would be required to purchase the property, <br />at fair market value? <br />Rupp replied that the comprehensive plan <br />indicates that if the area is shown for open <br />space the City, in conjunction with the County, <br />will look toward whatever means available to <br />attempt to purchase the property for fair <br />market value. <br />Ferrera inquired if the City presently had <br />the funds to purchase the property if it is <br />zoned open space. <br />Rupp replied not that he was aware of. <br /> <br />Councilman Ferrera called for a question <br />vote on the amendments to Ordinance #794. <br />3 Ayes - 3 Nays - Councilmen Fauson, Cummings <br />and Ferrera dissenting. Motion defeated. <br /> <br />Councilman Leary moved, Councilwoman Morris <br />seconded that Ordinance #794 - Consideration <br />of Possible Election or Repeal of Ordinance <br />#746 Biella Annexation be adopted. <br /> <br />Commented this is exactly what we have now <br />and the Court sent it back to us wanting <br />clarification and justification. Are we <br />going to send it back with no justification. <br />Or do we choose to do nothing and let Mr. <br />Biella take it back to Court. Wished clari- <br />fication. <br /> <br />Advised that if the ordinance is adopted the <br />Biella annexation would possibly go back to <br />Court. If the ordinance is not adopted, then <br />it would mean that Council's decision was not <br />to repeal Ordinance #746, which would leave <br />the other alternative of setting an election <br />on the matter. <br /> <br />Councilman Cussen called for a question vote <br />on the motion. Roll call vote was taken. <br />
