Director Rupp Councilman Ferrera Question Called on the Amend- ments \vTE ON ORDINANCE #794 Councilman Cussen Attorney Rautenstraus VOTE ON ADOPTION OF ORDINANCE #749 5/18/83 Page -23- Advised, presently the City did not have an ordinance that zones property open space. We have to develop a zone specifically for open space or develop or assign with the agricultural zoning district elimination of all uses on the site other than open space. Councilman Ferrera then inquired if the City would be required to purchase the property, at fair market value? Rupp replied that the comprehensive plan indicates that if the area is shown for open space the City, in conjunction with the County, will look toward whatever means available to attempt to purchase the property for fair market value. Ferrera inquired if the City presently had the funds to purchase the property if it is zoned open space. Rupp replied not that he was aware of. Councilman Ferrera called for a question vote on the amendments to Ordinance #794. 3 Ayes - 3 Nays - Councilmen Fauson, Cummings and Ferrera dissenting. Motion defeated. Councilman Leary moved, Councilwoman Morris seconded that Ordinance #794 - Consideration of Possible Election or Repeal of Ordinance #746 Biella Annexation be adopted. Commented this is exactly what we have now and the Court sent it back to us wanting clarification and justification. Are we going to send it back with no justification. Or do we choose to do nothing and let Mr. Biella take it back to Court. Wished clari- fication. Advised that if the ordinance is adopted the Biella annexation would possibly go back to Court. If the ordinance is not adopted, then it would mean that Council's decision was not to repeal Ordinance #746, which would leave the other alternative of setting an election on the matter. Councilman Cussen called for a question vote on the motion. Roll call vote was taken.
