Councilman Cussen also inquired about service to the Hot Tubs. Dagenais advised this was being engineered and will be installed soon. He quoted from a copy of the agreement which directed attention to Storer "the sale rep- resents that it may not be in compliance with local origination and other require- ments of certain of its franchises. Seller (Storer) further represents that its present compliance with said requirements is made a specific condition of transfer of said franchises by franchising authorities it would do those things necessary to fullfill the required conditions." Commented he would not want to accept this without a time line. Local Origination Mayor Meier Requested all councilmembers note their concerns and questions regarding Storer Cable T.V. and relay them to Attorney Rauten- straus; then a work session be set up with Storer Cable T.V. and Scripps-Howard Com- munications. Discussion by council regarding remote con- trol equipment to be used in the field; availability of studio production van; would fees remain the same, etc. Dick Lyons, Attorney with Grant, McCarren & Bernard of Longmont Mr. Lyons provided council with Scripps- Howard 1982 annual report of their financial condition. Mr. Lyons stated that section 23 of the present agreement that the City has with Storer does provide that City Council may certainly inquire as to the qualifications with the respect to the transferee of the permit. He then informed council of the background history of the Scripps-Howard Co. Advised they have presently constructed one- fourth of the City of Longmont and this evening some other members of their staff were in Lafayette formalizing the final agreement for the franchise there. They are negotiating with Storer - have completed their negotiations with Loveland, Louisville, Ft. Lupton and Parachute. It is a package deal. Clarified that the paragraph quoted by Mr. Dagenais was from a contract between Storer and Scripps- Howard and did not involve the City.
