<br />Page -4- <br /> <br />Councilman Cussen <br /> <br />vided up front in the form of a bond to assure <br />this would be done or set specific time lines. <br />Also, wished time lines for when Medema sub- <br />division would be installed. Councilman <br />Cussen also inquired about service to the <br />Hot Tubs. Dagenais advised this was being <br />engineered and will be installed soon. <br />He quoted from a copy of the agreement which <br />directed attention to Storer "the sale rep- <br />resents that it may not be in compliance <br />with local origination and other require- <br />ments of certain of its franchises. Seller <br />(Storer) further represents that its present <br />compliance with said requirements is made <br />a specific condition of transfer of said <br />franchises by franchising authorities it <br />would do those things necessary to fullfill <br />the required conditions." <br />Commented he would not want to accept this <br />without a time line. <br /> <br />Local Origination <br /> <br />Mayor Meier <br /> <br />Requested all councilmembers note their <br />concerns and questions regarding Storer <br />Cable T.V. and relay them to Attorney Rauten- <br />straus; then a work session be set up with <br />Storer Cable T.V. and Scripps-Howard Com- <br />munications. <br />Discussion by council regarding remote con- <br />trol equipment to be used in the field; <br />availability of studio production van; <br />would fees remain the same, etc. <br /> <br />Dick Lyons, Attorney with <br />Grant, McCarren & Bernard <br />of Longmont <br /> <br />Mr. Lyons provided council with Scripps- <br />Howard 1982 annual report of their financial <br />condition. Mr. Lyons stated that section <br />23 of the present agreement that the City <br />has with Storer does provide that City Council <br />may certainly inquire as to the qualifications <br />with the respect to the transferee of the <br />permit. He then informed council of the <br />background history of the Scripps-Howard Co. <br />Advised they have presently constructed one- <br />fourth of the City of Longmont and this evening <br />some other members of their staff were in <br />Lafayette formalizing the final agreement for <br />the franchise there. They are negotiating <br />with Storer - have completed their negotiations <br />with Loveland, Louisville, Ft. Lupton and <br />Parachute. It is a package deal. Clarified <br />that the paragraph quoted by Mr. Dagenais <br />was from a contract between Storer and Scripps- <br />Howard and did not involve the City. <br />
