PUBLIC COMMENT Michael Menaker, 1827 Choke Cherry Drive, Louisville, CO, urged Council to pass the resolution. As a member of a Louisville Revitalization Commission member, he felt comfortable about being governed by the rules established in the resolution. He urged Council to review such complaints in executive session. COUNCIL COMMENT Councilor Muckle requested clarification on felony convictions while serving on a board or commission. He asked that the term inefficiency be stricken from the resolution. He felt the language of physical and mental disability; harassing and hostile behavior was too broad and should be revised. Councilor Dalton felt the terms of mental and physical deficiencies were broad enough to remain in the resolution. Mayor Pro Tem Marsella felt the harassment and hostile behavior clause must remain. There was considerable discussion about who would make a recommendation to Council. Councilor Sackett suggested the Mayor make the recommendation. Councilor Muckle suggested a City Council member make the recommendation. Mayor Pro Tem Marsella disagreed a City Council member should make the recommendation. City Attorney Light noted the resolution includes a City Manager designee for such recommendations. Councilor Muckle suggested the Municipal Judge be the designee. Mayor Sisk explained the Municipal Judge may be in conflict should he be required to hear the ethics violation. MOTION: Mayor Pro Tem Marsella moved to approve Resolution No. 16, Series 2009, with the following amendments: Paragraph 2 (b) strike the word inefficiency, and remove section (f) all together. Councilor Dalton seconded the motion. Councilor Muckle offered a friendly amendment to reflect the City Manager may report his findings to the City Council. Mayor Pro Tem Marsella and Councilor Dalton accepted the amendment. City Attorney Light suggested the first sentence read as follows: "If the City Manager determines there may be grounds for removal, the City Manager shall present a report to the City Council for its consideration and action." VOTE: Roll call vote was taken. The motion carried by a vote of 7-0.
