Mayor Pro Tem Marsella agreed. <br /> <br />PUBLIC COMMENT <br /> <br />Michael Menaker, 1827 Choke Cherry Drive, Louisville, CO, urged Council to <br />pass the resolution. As a member of a Louisville Revitalization Commission <br />member, he felt comfortable about being governed by the rules established in the <br />resolution. He urged Council to review such complaints in executive session. <br />COUNCIL COMMENT <br /> <br />Councilor Muckle requested clarification on felony convictions while serving on a <br />board or commission. He asked that the term inefficiency be stricken from the <br />resolution. He felt the language of physical and mental disability; harassing and <br />hostile behavior was too broad and should be revised. <br /> <br />Councilor Dalton felt the terms of mental and physical deficiencies were broad <br />enough to remain in the resolution. <br /> <br />Mayor Pro Tem Marsella felt the harassment and hostile behavior clause must <br />remain. <br /> <br />There was considerable discussion about who would make a recommendation to <br />Council. Councilor Sackett suggested the Mayor make the recommendation. <br />Councilor Muckle suggested a City Council member make the recommendation. <br />Mayor Pro Tem Marsella disagreed a City Council member should make the <br />recommendation. City Attorney Light noted the resolution includes a City <br />Manager designee for such recommendations. Councilor Muckle suggested the <br />Municipal Judge be the designee. Mayor Sisk explained the Municipal Judge <br />may be in conflict should he be required to hear the ethics violation. <br /> <br />MOTION: Mayor Pro Tem Marsella moved to approve Resolution No. 16, Series <br />2009, with the following amendments: Paragraph 2 (b) strike the word <br />inefficiency, and remove section (f) all together. Councilor Dalton seconded the <br />motion. <br /> <br />Councilor Muckle offered a friendly amendment to reflect the City Manager may <br />report his findings to the City Council. Mayor Pro Tem Marsella and Councilor <br />Dalton accepted the amendment. <br /> <br />City Attorney Light suggested the first sentence read as follows: "If the City <br />Manager determines there may be grounds for removal, the City Manager shall <br />present a report to the City Council for its consideration and action." <br /> <br />VOTE: Roll call vote was taken. The motion carried by a vote of 7-0. <br />
