<br />City Council <br />Meeting Minutes <br />June 2, 2009 <br />Page 7 of 17 <br /> <br />Councilor Muckle suggested the divesture of a conservation easement require a <br />super majority vote of Council and with a time limit of 15 years. He <br />recommended the HPC make a recommendation on the distribution of funds. <br /> <br />PUBLIC COMMENTS <br /> <br />HPC Chairperson Whiteman addressed the issue of divesture of conservation <br />easements and asked when would there be public awareness and comments. <br />Mayor Sisk explained prior to any hearing, two to four week notice is required. <br /> <br />MOTION: Councilor Muckle moved to approve Resolution No. 20, Series 2009, <br />with the following changes: <br /> <br />· Page 2 Section 1 b the sentence will be revised to read "The City of <br />Louisville Historic Preservation Commission shall make recommendations <br />regarding expenditures"; <br />· Page 4 the word "rebates", in two places would be replaced with the word <br />"rei m bu rsements"; <br />· Page 5, regarding divesture, the last sentence shall be revised to read <br />"The divestment by the City of any conservation easement granted to it <br />shall require an affirmative vote of at least two-thirds (2/3) of the entire <br />City Council, and no divesture may be approved prior to 15 years after the <br />granting of the easement;" <br />· Page 5, Section f, the second sentence is revised to read "Any allocations <br />thereafter shall be as determined by City Council"; a third sentence will be <br />added to read: "The HPC may provide recommendations on allocations of <br />incentive funds on an annual basis"; <br />· Page 5 Section f, the first sentence shall read "In the first years of the <br />existence of the HPF, 50% of the incentives funds shall be set aside for <br />residential projects." <br /> <br />Councilor Dalton seconded the motion. Roll call vote was taken. The motion <br />carried by a vote of 7-0. <br /> <br />Mayor Sisk thanked the Historic Preservation Commission, Meredyth Muth and <br />Councilor Dalton and Muckle for their work on Resolution No. 20. <br /> <br />DISCUSSION/DIRECTION - DOWNTOWN DESIGN GUIDELINES AND OLD <br />TOWN OVERLAY REGULATIONS <br /> <br />Mayor Sisk requested a Staff presentation. <br /> <br />Public Relations Manager Muth reported the Historic Preservation Commission <br />(HPC) requests the City Council consider adding or changing the existing <br />Downtown Design Guidelines and Old Town Overlay Regulations to include <br />
