<br />lD/5/82 <br /> <br />Page -21.,.. <br /> <br />Councilman Cussen <br /> <br />Wished to know the status of the Night Club <br />designation at the Koshier Burrito. Commented <br />when he drove bYI there were no parking spaces <br />for 3 to 4 blocks available. He was concerned <br />this would be a weekly occurence. He also <br />felt that since their advertising stated <br />they were a Night Club, they were a Night <br />Club. <br /> <br />Councilwoman Morris <br /> <br />Stated she spoke with residents in the area. <br />Remarked the last time Council discussed this <br />issue the use had not changed. She inquired <br />what the criteria is that Council uses to <br />determine what is the change in the use and <br />whose responsibility this is. The general <br />complaint was not that the Koshier Burrito <br />was having Happy Hours if the band would end <br />at 9:00 P.M. But it seems that another band <br />comes in from 9:00 P.M. - 1:00 A.M. and the <br />establishment is becoming a Night Club. <br />She suggested that Council follow this up <br />and find out if they are in violation. <br /> <br />Councilman Fauson <br /> <br />Concurred with Councilwoman Morris that there <br />had been a change in use from a Restaurant <br />to a Night Club. He too had received com- <br />plaints from residents in the neighborhood <br />relative to the loud band. <br /> <br />Mayor Meier <br /> <br />Requested Attorney Rautenstraus to do the <br />follow-up on the situation. <br />Attorney Rautenstraus agreed to meet with <br />Director Rupp and the Building Inspector <br />to review the use. Will have a report at <br />the next council meeting. <br /> <br />Councilwoman Morris <br /> <br />Again inquired 1iVhat the criteria was to deter- <br />mine the use. <br />Attorney Rautenstraus replied by reviewing <br />accessory use, compliance use, etc. as stated <br />in the Municipal Code. This particular lo~ <br />cation is a non-conforming use, and these <br />ordinances will be reviewed also. <br /> <br />Director Leesman <br /> <br />Commented he recalled that when the liquor <br />license application came before Council, the <br />owner stated they would have music at the <br />esablishment, but was under the impression <br />it would be dinner music. <br />
