lD/5/82 Page -21.,.. Councilman Cussen Wished to know the status of the Night Club designation at the Koshier Burrito. Commented when he drove bYI there were no parking spaces for 3 to 4 blocks available. He was concerned this would be a weekly occurence. He also felt that since their advertising stated they were a Night Club, they were a Night Club. Councilwoman Morris Stated she spoke with residents in the area. Remarked the last time Council discussed this issue the use had not changed. She inquired what the criteria is that Council uses to determine what is the change in the use and whose responsibility this is. The general complaint was not that the Koshier Burrito was having Happy Hours if the band would end at 9:00 P.M. But it seems that another band comes in from 9:00 P.M. - 1:00 A.M. and the establishment is becoming a Night Club. She suggested that Council follow this up and find out if they are in violation. Councilman Fauson Concurred with Councilwoman Morris that there had been a change in use from a Restaurant to a Night Club. He too had received com- plaints from residents in the neighborhood relative to the loud band. Mayor Meier Requested Attorney Rautenstraus to do the follow-up on the situation. Attorney Rautenstraus agreed to meet with Director Rupp and the Building Inspector to review the use. Will have a report at the next council meeting. Councilwoman Morris Again inquired 1iVhat the criteria was to deter- mine the use. Attorney Rautenstraus replied by reviewing accessory use, compliance use, etc. as stated in the Municipal Code. This particular lo~ cation is a non-conforming use, and these ordinances will be reviewed also. Director Leesman Commented he recalled that when the liquor license application came before Council, the owner stated they would have music at the esablishment, but was under the impression it would be dinner music.
