<br />QUESTION ON THE MOTION <br /> <br />ORDINANCE #763 - SEWER BOND <br />1982 <br /> <br />PUBLICATION AUTHORIZED <br /> <br />Councilman Leary <br />Written Certificate by <br />-"'1.dependant CPA <br /> <br />6/1/82 <br /> <br />Page -4- <br /> <br />Councilman Leary referred to page 9 - <br />Section 7. "All ordinances or parts thereof <br />in conflict with this Ordinance are hereby <br />repealed." Inquired if there were any ord- <br />inances that applied to this section. <br />Attorney Rautenstraus replied possibly - none. <br />Further advised this was standard language <br />placed in ordinances of this type to pro- <br />tect the bond owners. <br /> <br />Question called for on the motion. All <br />in favor. Motion carried unanimously. <br /> <br />Each councilmember had a copy of the ordinance <br />before them. Attorney Rautenstraus read <br />the ordinance by title only and the request <br />was for council's authorization to publish it. <br /> <br />Councilman Ferrera moved, Councilman Fauson <br />seconded that Ordinance #763 - Sewer Bond, <br />1982 be published. <br /> <br />Referred to page 3 of the ordinance "City <br />Council, after a review of a written certificate <br />by an Independant Certified Public Accountant, <br />etc." - stated he hadn't personally reviewed <br />this. <br />Administrator Wurl and Mr. Dunn Krahl assured <br />Councilman Leary that he would be provided <br />a copy of the certificate prior to the second <br />reading of the ordinance. <br /> <br />Councilman Leary wished to emphasize that the <br />ordinance stated that if there is a problem, <br />the City is committing to raising sewer rates. <br />It was his opinion this was implied in 1975 <br />that certain commitments were being made and <br />he got the impression that maybe Council was in <br />violation of their ordinance at a certain <br />point and time <br /> <br />Leary inquired in the 1975 Sewer Bond issue, <br />was a fund established eqirivale_nt __to this <br />1982 issue - a $100,000.00 fund? <br />Wurl advised - yes. <br /> <br />Referred to page 13 - which specified that <br />City facilities pay a sewer service fee, <br />inquired when the budget is initiated could <br />this fee be projected as accurately as possible? <br />Administrator Wurl advised this fee could <br />be estimated. <br />
