Councilman Cussen PUBLICATION AUTHORIZED Councilman Leary RESOLUTION #15 - METZ SUBDIVISION APPROVAL RESOLUTION #16 - OLGA SCHRIETER SUBDIVISION - FINAL PLAT 4/20/82 Page -12- Inquired if this meant, under no conditions the City would be confining anyone under 18 years of age. Rautenstraus replied not for a municipal court violation. This is being done to follow the existing case law and statuatory law which states that the City cannot confine a minor - we would have to go thru juvenile court if the minor was to be confined. If we don't say that we are not going to con- fine minors, then it is possible that each time a minor is charged, because there was a slight possibility ofa jail sentence under our code, that might be an improper charge. Councilman Cussen moved, Councilman Cummings seconded that Ordinance #757 - Sentencing Minors be published. Question called for. All in favor. Motion carried unanimously. Inquired if the 48 hours confinement was consistent with State laws. Chief Leesman advised not in Boulder County. It was very difficult to confine a minor unless the charge is for a serious felony. Attorney Rautenstraus read the resolution in its entirety and advised Council Mr. and Mrs. Metz had signed the subdivision agreement. Each member had a copy. Director Rupp gave a brief presentation. Mr. Robert Hetz was in attendance to answer any questions. Councilwoman Horris moved, Councilman Ferrera seconded Resolution #15 - Series 1982, Metz Subdivision be approved. Question called for. All in favor. Motion carried unanimously. Each member of Council had a copy of the resolution. Attorney Rautenstraus read it in its entirety. Director Rupp informed Council the property was located at 404 County Line Road, zoned Residential Hedium, consisted of .88 acres, utilities were in place - the applicant wished to subdivide the property into 2 lots, there is a residence on one lot and no
