This is being done to <br />follow the existing case law and statuatory <br />law which states that the City cannot confine <br />a minor - we would have to go thru juvenile <br />court if the minor was to be confined. If <br />we don't say that we are not going to con- <br />fine minors, then it is possible that each <br />time a minor is charged, because there <br />was a slight possibility ofa jail sentence <br />under our code, that might be an improper <br />charge. <br /> <br />Councilman Cussen moved, Councilman Cummings <br />seconded that Ordinance #757 - Sentencing <br />Minors be published. Question called for. <br />All in favor. Motion carried unanimously. <br /> <br />Inquired if the 48 hours confinement was <br />consistent with State laws. <br />Chief Leesman advised not in Boulder County. <br />It was very difficult to confine a minor <br />unless the charge is for a serious felony. <br /> <br />Attorney Rautenstraus read the resolution <br />in its entirety and advised Council Mr. <br />and Mrs. Metz had signed the subdivision <br />agreement. Each member had a copy. <br />Director Rupp gave a brief presentation. <br /> <br />Mr. Robert Hetz was in attendance to answer <br />any questions. <br /> <br />Councilwoman Horris moved, Councilman Ferrera <br />seconded Resolution #15 - Series 1982, Metz <br />Subdivision be approved. Question called <br />for. All in favor. Motion carried unanimously. <br /> <br />Each member of Council had a copy of the <br />resolution. Attorney Rautenstraus read it <br />in its entirety. <br />Director Rupp informed Council the property <br />was located at 404 County Line Road, zoned <br />Residential Hedium, consisted of .88 acres, <br />utilities were in place - the applicant <br />wished to subdivide the property into 2 lots, <br />there is a residence on one lot and no <br />
