Councilman Cussen TROUSIL REQUEST - OUTSIDE WATER AND SEW TAP Davis Holder, Civil Enginner, Broomfield, Colorado Councilwoman Morris Councilman Cummings Councilman Ferrera Councilman Ferrera 4/20/82 Page -7- Commented that he concurred with Council- man Leary - he was prepared to vote no, but beca~lse of the amendments he voted yes. He also was concerned of similiar requests for waivers in the future. Councilmembers had a copy of the request. Director Rupp advised that the property was zoned industrial by Boulder County. It was not within the City limits. A referral had been sent to Boulder County, Planning Office, indicating that the City was opposed to the County industrial zoning, as our Comprehensive Plan had designated this land as open space. Staff recommended denial of the request. Represented Mr. Robert E. Trousil and he was retained by the applicant to design a small light industrial building. Mr. Holder advised that they have obtained a well permit and tests had been made to ver- ify that a ceptic tank would be operational. The property is contiguous with the city and is between the sewer line and a water line on Empire Road. Commented that there were 2 factors she felt very strongly about - one that it is outside the City's urban service area, and the other is that it is designated open space in our Comp Plan. It was her feeling that open space was a primary designation and would not like to encourage industry in the area. Wished to confirm that Boulder County had desig- nated the property as light industrial, and the City had designated the area as open space. Inquired why Boulder County allowed the industrial zoning when the City wanted the open space designation? Director Rupp replied he didn't know. The County designation may have been made several years ago. Commented that it was his opinion that Boulder County was not supporting the City's Comp Plan.
