He further advised present ordinances
do not require subdivision of any ground.be-
fore development takes place. They have
proceeded in that direction to amend the code
to include in the annexation agreement that
we get a cooperation for them to sub-divide.
The BSCS property has indicated that willing-
ness. So in effect, they are bound by the
annexation agreement to subdivide the property,
but if the City code was applied, they could
proceed with no subdivision under the present
code, if there wasn't an annexation agreement
that bound them to the subdivision process.
Neodata has indicated a willingness to pro-
ceed with that portion of the annexation
agreement of the subdivision process, and
at the same time are requesting that they
be given permission from Council to pro-
ceed with the building expansion, which
will take several months to finalize.
The subdivision process will take approxi-
mately 3 months, and in view of that time
frame, it was his opinion they were viewing
some avenues to pursue enabling them to
proceed with building plans while they are
subdividing the property. Rupp further ad-
vised it was not unusual for developers or
property owners to bring requests of this
kind to Council for consideration. Each
