MRC PROPOSAL Hayor Meier Councilman Leary vJUNCIL AUTHORIZATION SUPERIOR INTERCHANGE AGREEMENT 2/5/82 Page -12- Each member of council had a copy of a memo from Chief Accountant Caranci re- garding this proposal, which applied to excess money paid to Social Security considered unearned income-namely sick pay by the City and city employees. Wanted to clarify if the $500 retainer fee would be taken from the 50% of the money recovered by them. Accountant Caranci replied it would be. Inquired of Attorney Rautenstraus if this contract would fall under the bidding pro- cedures of the City. Rautenstraus advised since there is no pur- chase involved and the payment is on a per- centage basis; also the contract is to pro- vide a service to the City, it would not fall under the bidding procedure. Leary asked if the assistance in setting up a system to prevent this from happening again is included in the present cost. The reply was affirmative. Councilwoman Morris moved, Councilman Ferrera seconded that the Mayor and City Clerk be authorized to sign the MRC Contract for Social Security overpayments, contingent upon the City Attorney's review regading the bid process. Question called for. All in favor. Motion carried 6-0. Administrator Wurl reported at the State Hiway Commission meeting they considered the agreement, voted unanimously to approve it, and signed all the documents. In t hat pro- cess there was a change that Kahan and Homart bring money in lieu of a letter of credit, which necessitated a change in the agreement. At that time the Attorney General's office felt this did not require council's approval; therefore he had the Mayor and Clerk sign the revised documents. Mr. Kurtz-Phalen of the Governor's office would feel more comfortable if Council would ratify the amendment and tatify the Mayor and Clerk's signature.
