<br />1/19/82 <br /> <br />Page -4- <br /> <br />of council had changed, but the circumstances <br />had not; also felt since they had accepted <br />the referendum petition it was their statu- <br />tory duty to grant Mr. Biella's request <br />of a vote of the people. <br />Ms. Hughes defended Mr. Biella's commercial <br />zoning request that not just one area have <br />a monopoly for commercial development. <br /> <br />JOHN STOUT <br /> <br />John Stout of 300 Spruce St., Ward III <br />addressed his remarks to his council <br />representatives Fauson and Morris requesting <br />they vote in favor of letting this annexation <br />go to a vote of the .people. It is was his <br />opinion that persons circulating and signing <br />petitions should be aware of the costs in- <br />volved should an election be held - $8,000 <br />to $20,000. <br /> <br />OPPOSED TO THE ANNEXATION <br /> <br />Mayor Pro-tem Fauson asked if there was anyone <br />present who wished to speak against the <br />ordinance. <br /> <br />JANE BOSTWICK <br /> <br />Jane Bostwick of 1045 Main St. as one of <br />the delegated people who circulated a petition <br />advised council, Mr. Biella, and his attorney, <br />that the intention of the petition was a <br />sincere effort to present to council the <br />opportunity to reconsider. and repeal the <br />ordinance since it was premature because <br />a procedure for amending the comp plan <br />had not yet been adopted. There is now <br />a procedure and there is nothing that <br />prevents Mr. Biella from requesting an <br />amendment to the comp plan. It was not <br />the intention of their group to have this <br />go to a vote of the people but for council <br />to act with integrity to follow the compre- <br />hensive plan of Louisville. <br /> <br />COUNCIL CO:Ml1ENTS <br />COUNCILMAN CUMMINGS <br /> <br />Inquired what the official procedure is <br />presently to amend the comp plan-to his <br />knowledge it had been proposed but not <br />finalized. He referred to t1s. Bos twick' s <br />comment regarding the oath taken by members <br />of Council which was to uphold the Consti- <br />tution of the United States, State of Colo- <br />rado and City ordinances and according to <br />Article V of the referendum petition - any <br />laws council 'Wishes to enact or reject shall <br />be at the polls.
