<br />AMENDNENT TO THE ANNEXATION <br />AGREEHENT <br /> <br />PROPOSED M1ENDMENT TO THE SUB- <br />DIVISION AGREE~lliNT <br /> <br />DONALD KAHAN <br /> <br />DENNIS DRill1M, ASSOCIATED <br />LAND CONSULTANTS, 744 MAIN ST. <br /> <br />1/6/82 <br /> <br />Page -2- <br /> <br />Mr. French stated another concern of the <br />Governor's Office was one of land use. <br />The first payment to the City will be due <br />February 1, 1982 in the amount of $77,000. <br />At the closing of the bids the amount to <br />the City will be $150,000, then annual pay- <br />ments of $50,000 each. Also, a matching <br />fund of $50,000 with the City if it is able <br />in the years 1984 and 1985. <br /> <br />The first portion is to identify the prior <br />land use concept and what is proposed if <br />approved by the Highway Commission. Another <br />feature of this agreement is at a future <br />time if US 36 is expanded to 6 lanes their <br />company would have the opportunity to return <br />and request the original land use plan. <br />There is also a provision in this agreement <br />of pursuing the possibility of a golf course <br />on lands owned by the developer and the City. <br /> <br />Mr. French explained most of these were <br />housekeeping items. <br /> <br />Remarked it has been a long tune and a lot <br />of money; but the Highway Commission is will- <br />ing to postpone the meeting until the Homart <br />Board of Directors has met and will approve <br />the agree'ments as he was certain they would. <br />Mr. Kahan stated this project had been very <br />time consuming - in the same amount of time <br />we had completed 6 malls and 15 K-Mart develop- <br />ments. To get to this stage their company <br />has had an election, fought the City of <br />Boulder, Boulder County, Governor, DRCOG, and <br />he knew of no project that had been thru more <br />difficulty and will come to a successful <br />conclusion. He thanked Mayor and Council, <br />their predecessors, Howard Berry and Dwight <br />Bower of the State Highway Dept. and whatever <br />the outcome this evening he appreciated the <br />100% support given him. <br /> <br />Mr. Drumm advised he would deal with the land <br />use aspect of the project with negotiations <br />with the State of Colorado. The State's <br />main concern was the widening of Highway US36. <br />In the State Engineering Department they <br />determined 318,000 s.f. of commercial develop- <br />
