WHEREAS, there may also be applied to the purchase of fee title interests in and <br />conservation easements over the Northwest Parkway Open Space Parcels five million dollars <br />($5,000,000) of the funds to be made available for open space purchases from the financing <br />proceeds obtained by the entity or entities financing the Northwest Parkway, as provided in the <br />February 19, 1999, Northwest Parkway Intergovernmental Agreement among the City, County, <br />City of Broomfield and City of Lafayette; and <br /> <br /> WHEREAS, the City and County further intend to enter into such IGA for the purchase <br />and sale of a conservation easement over a certain parcel of real estate totaling approximately 21 <br />acres, depicted and described in Exhibit F, and generally located adjacent to the north side of U.S. <br />Highway 36 between South 88th Street and Centura Avista Hospital, for the purpose of open space <br />and conservation (the "Scriffiny Conservation Easement"); and <br /> <br /> WHEREAS, the City shall pay a total purchase price not to exceed one hundred and <br />twenty-six thousand dollars ($126,000.00), for the Scriffiny Conservation Easement; and <br /> <br /> WHEREAS, the City Council by this ordinance desires to identify the sources of funding <br />for such purchases and otherwise comply with Section 31-25-202, Colorado Revised Statutes. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> Section 1. Unless other funds become available for use by the City as determined by <br />the City Council, moneys from the following funds may be used to pay to the County during 1999 <br />the maximum two million dollar ($2,000,000.00) purchase price for Parcel 1 of the Parkway Open <br />Space Parcels, which Parcel 1 is depicted on Exhibit A and described in Exhibit C, each attached <br />hereto and incorporated herein by reference: <br /> <br />Conservation Trust-Land Acquisition Fund: <br />General Fund: <br /> <br />$1,500,000 <br /> 500,000 <br /> <br />Total $2,000,000 <br /> <br /> Section 2. Unless other funds become available for use by the City as determined by <br />the City Council, moneys from the Conservation Trust-Land Acquisition Fund may be used to pay <br />to the County during 2000 and 2001 a maximum, in each year, of eight hundred and seventy-six <br />thousand eight hundred and thirty-six dollars and seventy-five cents ($876,836.75) for Parkway <br />Open Space Parcels 2 and 3, which Parcels are depicted on Exhibit A and described, respectively, <br />in Exhibit D and E, each attached hereto and incorporated herein by reference. <br /> <br /> Section 3. There may also be applied to the purchase of fee title interests in and <br />conservation easements over the Northwest Parkway Open Space Parcels five million dollars <br />($5,000,000) of the funds to be made available for open space purchases from the financing <br /> <br /> <br />
