RESOLUTION NO.29 <br />SERIES 2022 <br />A RESOLUTION APPROVING AN AGREEMENT WITH DELLACAVA/TEBO <br />DEVELOPMENT CO., LLC FOR THE CITY'S LEASE OF OFFICE SPACE <br />WHEREAS, the City is a home -rule city and municipal corporation duly organized and <br />existing under and pursuant to Article XX of the Colorado Constitution and Charter of the City (the <br />"Charter"); and <br />WHEREAS, the City is authorized pursuant to the Charter, City ordinances, and state statutes <br />to enter into long-term leasehold agreements; and <br />WHEREAS, pursuant to Section 3.04.130 of the Louisville Municipal Code, any long-term <br />leasehold agreement entered into by the City must be approved by the City Council by ordinance or <br />resolution, as the City Council shall determine; and <br />WHEREAS, there has been prepared a lease agreement for the City's lease of office space <br />located at 1805 Highway 42, Suite 100, Louisville, Colorado, for use by the City's Human Resources <br />Department for a term of eighty-six (86) months (the "Agreement"), a copy of which Agreement <br />accompanies this Resolution; and <br />WHEREAS, the City Council desires to approve the Agreement by this Resolution. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The Lease Agreement ("Agreement"), by and between the City of Louisville <br />and DellaCava/Tebo Development Co., LLC, a copy of which Agreement accompanies this <br />Resolution, is hereby approved. <br />Section 2. The Mayor and City Clerk are hereby authorized to execute the Agreement, <br />and the Mayor is hereby further authorized to negotiate and approve such revisions to the Agreement <br />as the Mayor determines are necessary or desirable for the protection of the City, so long as the <br />essential terms and conditions of the Agreement are not altered. <br />PASSED AND ADOPTED this 71" day of June, 2022. <br />ATTEST: O' <br />SEAL <br />City Clerk C <br />®�ORADO <br />Resolution No, 29.
