RESOLUTION NO.29 SERIES 2022 A RESOLUTION APPROVING AN AGREEMENT WITH DELLACAVA/TEBO DEVELOPMENT CO., LLC FOR THE CITY'S LEASE OF OFFICE SPACE WHEREAS, the City is a home -rule city and municipal corporation duly organized and existing under and pursuant to Article XX of the Colorado Constitution and Charter of the City (the "Charter"); and WHEREAS, the City is authorized pursuant to the Charter, City ordinances, and state statutes to enter into long-term leasehold agreements; and WHEREAS, pursuant to Section 3.04.130 of the Louisville Municipal Code, any long-term leasehold agreement entered into by the City must be approved by the City Council by ordinance or resolution, as the City Council shall determine; and WHEREAS, there has been prepared a lease agreement for the City's lease of office space located at 1805 Highway 42, Suite 100, Louisville, Colorado, for use by the City's Human Resources Department for a term of eighty-six (86) months (the "Agreement"), a copy of which Agreement accompanies this Resolution; and WHEREAS, the City Council desires to approve the Agreement by this Resolution. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. The Lease Agreement ("Agreement"), by and between the City of Louisville and DellaCava/Tebo Development Co., LLC, a copy of which Agreement accompanies this Resolution, is hereby approved. Section 2. The Mayor and City Clerk are hereby authorized to execute the Agreement, and the Mayor is hereby further authorized to negotiate and approve such revisions to the Agreement as the Mayor determines are necessary or desirable for the protection of the City, so long as the essential terms and conditions of the Agreement are not altered.
