City Council <br />Meeting Minutes <br />March 1, 2022 <br />Page 5 of 13 <br />John Marlin asked if L&O is based on the ordinances in place at the time of the loss, in <br />this case should it cover the cost to build to the new stricter code the City adopted last <br />year. If the new code is rolled back will I still be eligible for the full L&O. <br />Conway stated that is a question they are investigating at the Division but they don't <br />have a good answer at this time. <br />Karen McCrudden, 1043 Turnberry Circle, stated their adjuster offered 50% payouts, <br />not 60% and she doesn't know who can review her documents for her to better <br />understand them. Conway suggested she contact his staff for help. <br />Brandon Garcia, asked if the L&O coverage should cover all code updates since the <br />home was built. Conway stated yes that is the case. <br />DISCUSSION/DIRECTION — BUILDING CODE CONSIDERATIONS <br />Planning Manager Ritchie stated this is a follow up from the February 1 meeting with <br />additional information on building codes related to the Marshall Fire rebuild. She noted <br />that in October the City Council adopted the 2021 International Energy Conservation <br />Code (IECC) with amendments and with the residential net -zero appendix. <br />As a result of the fire, we know over 500 homes need to be rebuilt. Staff asked Group <br />14 to analyze the different cost impacts of the new IECC code; they modeled the costs <br />on an average home lost in the fire. She noted costs for individual homes will vary <br />based on multiple factors and actual cost bids; these numbers are simply to understand <br />the general cost factors for an average home. Estimates will also be impacted by supply <br />chain, labor market, and construction issues. <br />The additional cost to build to the 2021 IECC versus to the 2018 code is estimated at <br />approximately $20,000 to $25,000. There are opportunities for rebates and incentives <br />being offered by Xcel and SunShare Community Solar to help offset some of these <br />costs. She reviewed various options and some ways costs are affected. <br />Public Comments <br />Dave Houston, 949 Larkspur Lane, stated their insurance will not cover their rebuild <br />costs and urged the Council to help reduce costs by suspending the 2021 code. <br />Kristen T, resident of Fraser, stated net zero building is doable and can be cost <br />effective. <br />Maria McClure, 105 Cherrywood Lane, stated the cost estimates given tonight are <br />inaccurate and people are struggling to rebuild even to what they had. She stated the <br />costs are not solid and no builder can commit to them. <br />
