RESOLUTION NO. 8 <br />SERIES 2022 <br />A RESOLUTION RECOMMENDING DENIAL OF AN ORDINANCE AMENDING THE <br />LOUISVILLE MUNICIPAL CODE TITLE 17, ZONING, TO AMEND THE <br />REQUIREMENTS FOR INCLUSIONARY HOUSING IN CHAPTER 17.76 <br />WHEREAS, Colorado statutes require municipalities to include within their <br />comprehensive plans provisions that will promote affordable housing; and <br />WHEREAS, by Resolution No. 58, Series 2017, adopted on November 6, 2018, <br />the City endorsed the Boulder County Regional Housing Partnership, which <br />recommends a goal of ensuring twelve percent (12%) of the housing inventory will be <br />permanently affordable to low-, moderate-, and middle -income households by 2035; <br />and <br />WHEREAS, on May 13, 2021, the Planning Commission approved Resolution <br />No. 4, Series 2021, recommending approval of an ordinance to adopt Inclusionary <br />Housing requirements for the City of Louisville; and <br />WHEREAS, on June 15, 2021, City Council approved Ordinance No. 1809. <br />Series 2021 which established Chapter 17.76 - Inclusionary Housing in the Louisville <br />Municipal Code; and <br />WHEREAS, House Bill 21-1117, adopted by the Colorado General Assembly <br />and signed into law by the Governor on May 28, 2021, clarified that the existing <br />authority for cities to plan for and regulate the use of land includes the authority to <br />regulate development or redevelopment in order to promote the construction of new <br />affordable housing units; and <br />WHEREAS, City Council included on the 2022 Work Plan consideration of an <br />ordinance to require 30% inclusionary housing for property that is rezoned from a non- <br />residential zone district to a zone district that allows residential development; and <br />WHEREAS, the Planning Commission held a public hearing concerning the draft <br />ordinance amendment on June 9, 2022, at which evidence and testimony were entered <br />into the record; and <br />WHEREAS, after consideration of the evidence and testimony presented at the <br />public hearing and based on the following findings, the Planning Commission voted 6-1 <br />to direct City staff to draft a resolution recommending the City Council deny the draft <br />Ordinance. <br />NOW THEREFORE, BE IT RESOLVED that the Planning Commission of the <br />City of Louisville, Colorado does hereby recommend denial of a draft ordinance to <br />amend the inclusionary requirements within Chapter 17.76 of the Louisville Municipal <br />Code and adopts the following findings in support of the recommendation for denial: <br />Commission Finding: The Commission is supportive of additional inclusionary <br />housing within the City and finds that this position is supported by the following <br />policies within the Comprehensive Plan: <br />We <br />
