Charles: Agrees with Peter. We keep moving the goalposts, and we're getting a good deal. <br />Helen: We and the citizens would like to consider further the possibility of moving Campus Drive <br />further south. <br />Susan: Can the 47 acres be developed? Geoff: Per the IGA (which expires in 2029) they could <br />build 6 homes and the rest of the land would have to be placed in a conservation easement. <br />Peter: Not comfortable asking for more open space than the applicant is willing to give. We have <br />no legal right to demand more. They have use by right. He cannot support a request for more <br />land dedication. The PUD process is the time to ask for more open space in exchange for <br />enhanced building height. <br />Rob: PUD process is the only opportunity to adjust building height. OSAB could be brought in at <br />that time since the development would be contiguous to open space. We could put that <br />condition into our recommendation. <br />David: summarized possible recommendations in preparation for a final vote, including pursuing <br />legal commitment by developer to dedicate 47.4 acres north of Campus Drive as open space, <br />an additional underpass at Rockcress Drive, OSAB involvement in PUD review, and ensure <br />underpass design meets city standards. Noted that there doesn't currently seem to be clear <br />support for asking for more open space with a tradeoff of clustering and higher building heights, <br />so that can be considered in a future OSAB review of the PUD. <br />Motion Language: OSAB recommends approval of the revised proposed final plat contingent <br />on: <br />1. A legal commitment by the developer to rehabilitate and dedicate the 47.4 acres in <br />Boulder County (paradise lane properties) for jointly managed Louisville and Boulder <br />County Open Space. <br />2. The developers follow the current city standards for underpasses consistent with the <br />McCaslin Underpass and Harper Lake. <br />3. OSAB participation in the PUD review process. <br />4. The developers and city continue to work on creating safe trails and the possible <br />addition of a 3rd underpass. <br />Helen made a motion to approve as submitted and amended with conditions. Peter seconded. <br />Vote: Passed unanimously by Peter, Helen, Charles, David, and Susan. <br />
