City Council <br />Meeting Minutes <br />March 15, 2022 <br />Page 3 of 10 <br />DISCUSSION/DIRECTION — INTERGOVERNMENTAL AGREEMENT WITH BOULDER <br />COUNTY AND TOWN OF SUPERIOR REGARDING DEBRIS REMOVAL <br />City Attorney Kelly stated Boulder County went through a procurement process for a <br />contractor to conduct the Private Property Debris Removal needed after the Marshall Fire <br />and awarded a bid for the work. This IGA is between Louisville, Superior, and Boulder <br />County and covers how Superior and Louisville will pay for the local match for debris <br />removal and it establishes the framework for the contract oversight. <br />This evening staff is seeking some direction on the costs in the IGA. If the City wants to <br />use the contractor to do any work that is not going to be reimbursable by FEMA it should <br />be included in the IGA. <br />She noted that the original requirement that the City pay 12% of the costs will now likely <br />be changed to 5% if additional federal funding is secured. The Council should include a <br />not to exceed number in the IGA with that new information in mind. <br />City Attorney Kelly noted the lawsuit filed against Boulder County regarding open <br />meetings rules and this contract is ongoing, but the County has asked for an expedited <br />hearing. The goal is for the three entities to have the IGA ready to go so that as soon as <br />the lawsuit is resolved the project can move forward. <br />City Manager Durbin stated they met with the contractor today to discuss how items such <br />as patios, driveways, trees, etc. might be handled. We hope to have more details and <br />clarity on how this will work in the next few days and what the costs will be. <br />Public Comments — None. <br />Councilmember Maloney stated this is an important contract and we have to get the <br />details right. He would like more information on the non reimbursable costs before moving <br />forward. <br />Members asked specifically for details on the costs related to all of the non FEMA eligible <br />costs including flatwork (driveways and patios) and landscaping be included in the not to <br />exceed number when this comes back. <br />RESOLUTION NO. 16, SERIES 2022 — A RESOLUTION APPROVING A BUSINESS <br />ASSISTANCE AGREEMENT WITH BASECAMP LOUISVILLE, LLC FOR AN <br />ECONOMIC DEVELOPMENT PROJECT IN THE CITY OF LOUISVILLE <br />Director Pierce stated Basecamp Louisville LLC, doing business as Ironton Distillery, is <br />considering relocating its distillery and taproom to Louisville. They opened in Denver in <br />2018 and are looking at redeveloping an existing 4,000 sf space at 1303 Empire Road <br />and adding an additional 15,000 square feet of new commercial space. The applicant <br />
