City Council <br />Meeting Minutes <br />March 21, 2022 <br />Page 2 of 3 <br />RESOLUTION NO. 19, SERIES 2022 — A RESOLUTION APPROVING AN <br />INTERGOVERNMENTAL AGREEMENT FOR THE PROVISION OF ASSISTANCE FOR <br />DEBRIS REMOVAL RESULTING FROM THE COLORADO WILDFIRES AND <br />STRAIGHT-LINE WINDS DISASTER (DR-4653-CO) <br />City Manager Durbin stated the Private Property Debris Removal project is a huge <br />milestone for the community after the Marshall Fire. This intergovernmental agreement <br />(IGA) confirms the contract for the project, the costs associates with PPDR, and the roles <br />of Louisville, Superior, and Boulder County. <br />It include as "not to exceed" number of $6.5M based on a per parcel average cost <br />estimated at just under $43,000. However, there are a number of variables for which we <br />don't yet have costs. Additionally, we are waiting for confirmation of what is eligible for <br />FEMA reimbursement and what may not be included in the debris removal process. <br />City Manager Durbin stated the not to exceed number in the draft does not cover those <br />properties that have opted out of the program. Any insurance coverage for debris removal <br />will go towards the contract cost. We are assuming a 90/10 reimbursement from FEMA <br />meaning 5% from the City and 5% from the state for the local match. He reviewed the line <br />items of the contract costs. <br />Mayor Stolzmann noted the urgency of getting this done so we can help the community <br />move forward. She noted FEMA reimbursement is not a sure thing so she asked the <br />Council to eliminate the asbestos concrete line from the not to exceed number. She <br />stated these homes were built in the 1990s so there is a very low chance they have <br />asbestos concrete in them. She noted that some families won't want to have driveways <br />and patios removed. If those numbers are removed we could lower the not to exceed <br />number to $4.OM. She supported this as it would limit the City's liability as we have not <br />seen the actual contract yet. <br />Public Comments — None. <br />Councilmember Maloney stated it is in the best interest of the City and the residents that <br />the City cover the non reimbursable FEMA costs. He suggested using a number of $4.5M <br />to give some leeway on the costs for removing hardscape. <br />Councilmember Brown noted we can raise the not to exceed number in the future if we <br />need to. <br />MOTION <br />Councilmember Maloney moved to approve the IGA with a revised not to exceed number <br />of $4.5M; seconded by Councilmember Most. <br />VOTE: Motion passed by unanimous roll call vote. <br />
