in l 11 Ell �I Boulder County Clerk, CO ORD 1 II 2221750 Page: 2 of 18 11/21/2001 11:43R R 90.00 D 0.00 certain portions of the Properties within the original alignment of the Northwest Parkway; and WHEREAS, pursuant to the City/County IGA and amendment thereto, it is proposed that the City and County shall become owners of undivided one-half interests over the Properties, excluding the new alignment of the Northwest Parkway, and the owners of reciprocal conservation easements over such Properties, excluding the new alignment of the Northwest Parkway, as further described in the City/County IGA and proposed amendment thereto; and WHEREAS, the City is authorized to execute the proposed amendment to the City/County IGA pursuant to state law, including but not limited to section 18 of article XIV of the Colorado Constitution and part 2 of article 1 of title 29, C.R.S.; and WHEREAS, the City Council has held a public hearing on the proposed amendment to the City/County IGA after proper public notice; and WHEREAS, the City, by this Ordinance and in accordance with the IGAs, desires to authorize the conveyance of those portions of the Properties necessary for the new alignment of the Northwest Parkway, provided that undivided one-half interests in certain portions of the original alignment of the Northwest Parkway are conveyed to the City; and WHEREAS, the lands to be conveyed by the City are not and will not be held or needed for any park or governmental purpose; and WHERAS, City Council finds that the proposed amendment to the City/County IGA is in the best interests of the City and its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. The proposed Amendment to Intergovernmental Agreement between the City of Louisville and the County of Boulder, a copy of which is attached hereto and incorporated herein by this reference, is hereby approved. Section 2 The Mayor is hereby authorized to execute the attached Amendment to Intergovernmental Agreement on behalf of the City Council of the City of Louisville, except that the Mayor is hereby granted the authority to negotiate and approve such revisions to said Intergovernmental Agreement as the Mayor determines are necessary or desirable for the protection of the City, so long as the essential terms and conditions of the Amendment Intergovernmental Agreement are not altered. Section 3. The Mayor, City Administrator and City Staff are further authorized to do all things necessary on behalf of the City to perform the obligations of the City under the Amendment
