V <br />i <br />111 11 1 111 11 <br />Boulder County Clerk, CO ORD <br />AMENDMENT TO INTERGOVERNMENTAL AGREEMENT <br />CITY OF LOUISVILLE AND BOULDER COUNTY <br />This Amendment to Intergovernmental Agreement (the <br />"Amendment") by and between the City of Louisville, a Colorado <br />statutory city ("Louisville") and the County of Boulder, a body <br />corporate and politic of the State of Colorado ("County"); <br />(collectively the "Parties") is made to be effective on the <br />day of June, 2001. <br />i <br />RECITALS <br />III 2221750 <br />Page: 4 of 18 <br />11/21/2001 11:43R <br />R 90.00 D 0.00 <br />This Amendment is made with respect to the following facts: <br />A. The Parties entered into that certain Intergovernmental <br />Agreement City of Louisville and Boulder County, dated June 17, <br />1999 and recorded August 3, 1999 at Reception No. 1967531 (the <br />"Louisville/County IGA"). <br />B. The Louisville/County IGA provided, inter alia, that <br />certain properties designated in the Northwest Parkway I.G.A. as <br />City Preservation Areas, and referred to as the Trillium Property <br />and BCLV Property (collectively the "Properties"), would be <br />acquired by the County. Louisville would pay a portion of the <br />cost of the Properties over a period of time and ultimately <br />receive an undivided one-half interest in the Properties, <br />excluding the right-of-way for the Northwest Parkway. <br />C. County acquired the Properties from Trillium and BCLV in <br />May, 1999. Pursuant to the Louisville/County IGA, Louisville <br />acquired Trillium Parcel 1 in July, 1999, by Special Warranty <br />Deed recorded on at Reception No. <br />and Quitclaim Deed for the mineral and water rights recorded on <br />at Reception No. . Louisville <br />acquired Trillium Parcel 2 in June, 2000 by Special Warranty Deed <br />recorded on at Reception No. and <br />Quitclaim Deed for the mineral and water rights recorded on <br />at Reception No. . Louisville is <br />scheduled to acquire Trillium Parcel 3 on July , 2001. <br />D. To ensure preservation as open space, County received <br />conservation easements in gross over Trillium Parcels 1 and 2 <br />from Louisville, which conservation easements were recorded on <br />August 3, 1999 at Reception No. 1967534 and June, 2000 at <br />Reception No. . County is scheduled to acquire a <br />conservation easement in gross over Trillium Parcel 3 on July , <br />2001. Louisville also acquired a conservation easement in gross <br />over Trillium Parcel 4 from County, recorded on August 3, 1999 at <br />Reception No. .
