Denied on Second Reading <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br />Section 1. Section 17.44.050 of the Louisville Municipal Code is hereby amended to <br />read as follows (words added underlined; words deleted st-Fie n): <br />Sec. 17.44.050 Declaration of policy for rezoning. <br />A. For the purpose of establishing and maintaining sound, stable and <br />desirable development within the city, the rezoning of land is to be discouraged. <br />Rezonings should only be considered i£ <br />1. The land to be rezoned was zoned in error and as presently <br />zoned is inconsistent with the policies and goals of the <br />city's comprehensive plan; <br />2. The area for which rezoning is requested has changed or is <br />changing to such a degree that it is in the public interest to <br />encourage a redevelopment of the area; <br />3. The proposed rezoning is necessary in order to provide land <br />for a community -related use which was not anticipated at <br />the time of the adoption of the city's comprehensive plan, <br />and such rezoning will be consistent with the policies and <br />goals of the comprehensive plan; of <br />4. The rezoning would only permit development which, if <br />evaluated as a proposed annexation under the annexation <br />standards and procedures codified in title 16, would qualify <br />for annexation.- , or <br />5. The area to be rezoned is rezoniniz from a commercial land <br />use to a land use that includes residential, and the property <br />owner elects to permanently deed restrict thirty percent <br />(30%) of the new residential units on site as affordable <br />housing. For purposes of this subsection: <br />(a) "Rezoning" also includes approval of any <br />amendment under the City's zoning code that would <br />increase the area of a property on which residential <br />uses are allowed or increase the number of <br />residential units, to the extent of such increase. <br />(b) "Affordable" shall mean dwelling units that are <br />restricted to ownership or rental by those persons <br />Ordinance No. 1839, Series 2022 <br />Page 4 of 16 <br />
