<br />PINE STREET EXTENSION CaNT'n <br /> <br />Councilman Meier <br /> <br />Councilman Cummings <br /> <br />2/17/81 <br /> <br />Page - 5 - <br /> <br />extension of Pine St. It was his <br />recommendation to Council that if <br />the extension of Pine St. was not <br />resolved in two weeks, Council <br />take %hatever steps were necessary <br />to resolve it. <br />Administrator vJurl supported Coun- <br />cilman Carnival's recommendation, <br />stating it has been very difficult <br />to make ~1r. Metz understand the <br />City's obligatioh in the original <br />contract with Centennial Valley <br />if the developers were unable to <br />resolve the extension of Pine St. <br />the City would condemn the property. <br />He felt that if the subdivision <br />is approved and Mr. Metz recog- <br />nizes that the Council has approved <br />that subdivision, and that it is <br />progressing, then maybe the prob- <br />lem will be resolved. I1r. Wurl <br />further stated if the City lies <br />back and says they are not going <br />to do anything until that problem <br />is resolved, it was his opinion <br />Nr. Hetz would continue to stall. <br /> <br />Stated he concurred with Councilman <br />Carnival and Administrator Wurl, <br />and suggested Mr. Metz be given a <br />month's time to come to an agree- <br />ment with l1cStain or the City <br />would take action to resolve the <br />extension of Pine St. <br /> <br />Inquired of Attorney Joss - if <br />Council approved the replat of the <br />Stockade and McStain Enterprises <br />started building, could Nr. Metz <br />sue. Attorney Joss was of the <br />opinion he would have no claim. <br />Councilman Cummings inquired about <br />the fees for condemning. Adminis- <br />trator Wurl advised it was the <br />developers responsibility to pay <br />the fees. <br />
