Open Space Advisory Board <br />Minutes <br />August 10, 2022 <br />Page 4 of 7 <br />Catherine said that Ember cautioned the board that the new trail type designation would <br />represent enough of a policy change that it would need to go to council and through a <br />public process. <br />Other Board Updates: <br />David commented that he loved the new "enjoy the beautiful views" signs at Aquarius. <br />Catherine said that she and Ginger had put those up. <br />Ember emailed David and Jessamine that the Boulder County trail & property acquisition <br />recommendation review would be due in February. <br />David will be meeting with the chair of the sustainability board next week and asked for <br />ideas for discussion topics. Laura suggested sharing the wayfinding presentation with <br />them, arguing that wayfinding will help people travel in the city without using their cars. <br />David announced that Peter Gowen will be stepping down after September because he <br />will be moving away from Louisville. Jessamine asked about the work on city code <br />language that Peter had been working on for the board and whether there was a way for <br />Peter to share out to the board what he had done before we lose him. <br />7. Public Comments on Items Not on the Agenda <br />A. Jean Morgan 1131 Spruce Street. Ms. Morgan told the board that she lives just west <br />of Highway 42. She is concerned about the buildings going up at 10064 Empire Rd, just <br />where the Coal Creek goes under Empire Rd.; she is concerned that they violate the <br />terms of the conservation easement on the property. She asserted that the previous <br />permits for additions on the property were for additions set back from the road. The <br />current landowners have built a two -car garage near the road and there is now a <br />second -story addition on top of the garage (she provided the board with a photo). She <br />thinks this is being built in violation of the permit. She thinks it is being built too close to <br />the open space property line. She thinks this is a mockery of the conservation <br />easement. She would like to see the OSAB get involved in enforcing the rules. She <br />provided a typed letter to the board, which will be included in the minutes. <br />TRANSCRIPTION OF JEAN MORGAN'S LETTER. <br />8/10/2022 <br />10064 Empire Rd. <br />As the Louisville Open Space Board which has interest in the Mayhoffer Conservation Easement with <br />Lafayette and Boulder County, I would like to address my concerns to you about the property south of the <br />creek on Empire Road at 10064 Empire Road. <br />#1. 1 believe the previous permits for the building improvements have been placed back on the property, not <br />on Empire Road where they are visible to the public. The current permit is located on Empire Road, but it is <br />hidden by weed and not very visible. <br />#2. 1 believe that the two -car garage had a permit, but the owners built a second -story apartment above it <br />without a permit. To me, this is a ploy to get a permit after -the -fact... `Well, we're sorry, but since we have <br />already made the investment, can't you give us a permit?' I heartily disagree with this type of shenanigans <br />and strongly believe this should not be rewarded!! <br />#3. Furthermore, I believe the two -garage is illegally placed too close to the property line (at about 35')... I <br />believe the setback should be 50'-100' from the property line. <br />#4. An illegal building should not be permitted on our Mayhoffer Conservation Easement property. It sets a <br />precedent; it mocks the regulations and the procedures for building on our community -sponsored, publically- <br />enjoyed, citizen -subsidized public lands. <br />Please get involved in this project and help keep our public lands regulated. <br />
