<br />. <br /> <br />LEACHATE MARHALL LAKE LANDFILL <br /> <br />COUNILMAN CARNIVAL <br /> <br />Page - 4 - <br /> <br />12/2/80 <br /> <br />Director Rupp reported that a recerti- <br />fication of all residents will be made <br />January 1, 1981 and if the tenant con- <br />tinues to be uncooperative we will ask <br />him to leave. <br />Director Rupp also advised that the <br />architect and contractor refuse to <br />take responsibility for the defaults. <br />Councilman DelPizzo suggested that <br />they be taken to court to correct the <br />problems. <br />Director Rupp advised that as soon as <br />he received the report from the con- <br />structural engineer he would contact <br />the City Attorney to see if legal action <br />should be taken. <br /> <br />Inquired if Boulder County was telling <br />the City to abandon our ditch and put <br />in a pipeline at the City's expense. <br />It was his opinion that Boulder County <br />had created the problem and legal action <br />be taken against them. <br />Administrator Wurl advised that it was <br />his opinion that the City need do any- <br />thing about the leachate problem. EPA <br />is threatening to take legal action <br />against Boulder County. The pipeline <br />was part of the City's plan and the <br />Centennial Valley Mall developers are <br />required to do this to service their <br />area. It is not the City's intention <br />to size the pipeline to accommodate <br />all t:he water that flows down Community <br />Ditch. The pipeline will be sized to <br />accorrmodate the flows that are suffi- <br />cient to supply the City of Louisville. <br />This will resolve Louisville's part <br />of the problem <br />Councilman DelPizzo requested that <br />Council be supplied with the Boulder <br />County water reports. <br />Administrator Wurl stated there has <br />not been a problem with contaminants <br />at the present. The concern of the EPA <br />is the potential of the problem in the <br />future. <br /> <br />Inquired of Administrator Wurl if the <br />realignment of Main St. would go to <br />
