44P <br />Boulder County Clerk, CO VACATION R 10.00 D 0.00 <br /> <br />VACATION OF EASEMENT <br /> <br /> THIS VACATION OF EASEMENT is made this ,~/9~C'day of [~f6//d~/, 2001, <br />by the City of Louisville, a municipal corporation existing under and by virtue of the laws of the <br />State of Colorado ("City"), whose address is 749 Main Street, Louisville, Colorado 80027. <br /> <br />RECITALS <br /> <br /> WHEREAS, by document recorded January 23, 1995, as Plan File P-33, F-2, #3, and Film <br />No. 2032, Reception No. 1493909, Boulder County' Records, there was dedicated to the City a 50- <br />foot by 190-foot joint access easement lying within Lots 2 and 3 of Alvenus Park Subdivision, a <br />subdivision in the City of Louisville, County of Boulder, State of Colorado (the "Joint Access <br />Easement"); and <br /> <br /> WHEREAS, proper application was made to the City for vacation of the Joint Access <br />Easement; and <br /> <br />WHEREAS, the City Council by Ordinance has approved the application for vacation; <br /> <br />and <br /> <br /> WHEREAS, the City Council has determined that the Joint Access Easement to be <br />vacated is not and will not be needed for any public purposes; and <br /> <br /> WHEREAS, the City Council has determined that the Joint Access Easement to be <br />vacated is not being used or held for park purposes or for any other governmental purposes. <br /> <br /> NOW, THEREFORE, the City of Louisville hereby vacates its interests in that certain <br />50-foot by 190-foot joint access easement lying within Lots 2 and 3 of Alvenus Park <br />Subdivision, a subdivision in the City of Louisville, County of Boulder, State of Colorado, as set <br />forth in the subdivision plat thereof recorded January 23, 1995, as Plan File P-33, F-2, #3, and Film <br />No. 2032, Reception No. 1493909, Boulder County Records. The City reserves and does not vacate <br />its interest in that certain 1 O-foot utility easement lying within the southernmost ten feet of such <br />joint access easement. Further, easements for existing public utilities, if any, shall not be altered <br />or amended by virtue of this Vacation of Easement. <br /> <br /> IN WITNESS WHEREOF, the City has executed this Vacation of Easement on the day <br />and year first above written. <br /> <br />CITY OF LOUISVILLE, COLORADO <br /> <br />By: <br /> <br /> <br />
