That area is to <br />be developed by the city to be a park. In the public comments, there were concerns <br />about the suitability of that land. She asks staff's opinion on that. <br />Zuccaro says he would not say the city has done an engineering feasibility study. Staff <br />has visited the property and it would take grading and flattening of some areas of the <br />property. There was no concern expressed by the parks department though during their <br />site visit. <br />Moline says the developer would be responsible for that grading correct? <br />Zuccaro says that it is not included in the proposal. <br />Howe asks staff to comment on the plan to provide water and if there is any plan to re- <br />use the water. We are not receiving more water for this development correct? <br />Zuccaro says the city does charge tap fees for new development. Part of those fees go <br />towards new water rights acquisitions. The city requires water to accommodate new <br />development. The applicant will have to build a main line as well internal lines. <br />Howe asks if we just passed the preliminary plat, it would come back to the commission <br />in 12 months. What change in the presentation would that have for the final plat? <br />Zuccaro says the final plat would have to conform to the preliminary plat. You cannot <br />really make major changes to the proposal. It is just about finishing the detailed <br />elements of the plat. <br />Applicant Presentation: <br />Jay Hardy, Brue Baukol Capital Partners <br />Hardy says he does not have a presentation but they did have follow up comments and <br />reports that are in the packet. <br />Commissioner Questions of Applicant: <br />1.12.46-1.15.15 <br />Moline asks how they will have the Transportation Demand Management (TDM) and <br />sustainability commitments apply to the people in the development. <br />Hardy TDM activities will be tied to the Subdivision Improvement Agreement (SIA) so it <br />will be implemented and executed that way. The TDM program, he suspects, would be <br />the same. The one exception is related to the solar generation. <br />Moline says some of the ERO reports provide recommendations. How would you go <br />about following through on those commitments? <br />Hardy asks for a specific example. <br />Moline mentions the prairie dog management plan. He wonders how to hold them to <br />these recommendations. <br />Hardy says that they have not said that they would not follow or would go against them. <br />If we need another exhibit to the SIA then we could do it that way. <br />Howe asks for clarification on the water and sewer contributions. <br />Hardy says within the first phase, the lift station in the southeast corner will be built at <br />the very beginning. 100% of that is paid from the metropolitan district. Once we get to a <br />certain threshold of development, then we will go through the process of getting the <br />treatment plant expanded. <br />Brauneis asks about their light version and how it is not the full version that was <br />previously proposed. It seems like it is full of loopholes. <br />Hardy mentions that they had 13 conditions last fall and many of those are either being <br />met through a different path or they are irrelevant. <br />11 <br />
