**No action was taken by Council during the 09/06/22 <br />meeting so the ordinance did not take effect. <br />ORDINANCE NO. 1840 <br />SERIES 2022 <br />AN ORDINANCE APPROVING THE VACATION OF TWO FIVE-FOOT SURFACE <br />MAINTENANCE EASEMENTS, A 30' WIDE CITY EXCLUSIVE UTILITY EASEMENT <br />AND A 10' WIDE UTILITY EASEMENT, DEDICATED BY THE PLATS OF <br />LOUISVILLE TRADE CENTER AND DELO LOFTS <br />WHEREAS, by the plat of Delo Lofts, recorded in the Office of the Boulder County Clerk <br />and Recorder on June 29, 2017 at Reception No. 03600743, there was dedicated to the City two 5- <br />foot wide surface maintenance easements, a 30-foot wide city exclusive utility easement, and a 20- <br />foot wide private utility easement for such Subdivision in the location further described in Exhibit A <br />attached hereto; and <br />WHEREAS, by the plat of Louisville Trade Center, recorded in the Office of the Boulder <br />County Clerk and Recorder on August 7, 1984 at Reception No. 638267, there was dedicated to the <br />City a 10 foot utility easement on Lot 101 of such Subdivision in the location further described in <br />Exhibit A attached hereto; and <br />WHEREAS, a Final Planned Unit Development and Subdivision Plat application have <br />been approved by the City for re -subdivision of property encumbered by the above referenced <br />easements under the name Delo Lofts Subdivision Amendment 1; and <br />WHEREAS, the City Council finds and determines that vacation of the easements for which <br />vacation is requested is not and will not be needed for any public, governmental or utility purposes; <br />and <br />WHEREAS, the City Council desires to approve the application and vacate the City's <br />interests in the easements for which vacation is requested; <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The City hereby approves the vacation of the certain 5 foot wide surface <br />maintenance easements, the 10 foot wide utility easement and the 30 foot wide city exclusive utility <br />easement, which easements herein vacated is in the locations further described in Exhibit A attached <br />hereto and incorporated herein by this reference. <br />Section 2. All other ordinances or portions thereof inconsistent or in conflict with this <br />ordinance or any portion hereof are repealed to the extent of such inconsistency or conflict. <br />Section 3. The Mayor and City Manager, or either of them, is authorized to execute such <br />additional documents as may be necessary to evidence the vacation easements herein vacated, <br />including but not execution of quit claim deeds. <br />Ordinance No. 1840, Series 2022 <br />Page 1 of 15 <br />
