Ayes, Councilman DiCarlo, No. <br />Motion carried. <br /> <br />Administrator Wurl informed Council the <br />request for annexation was for land adjacent <br />to CTC, and brought attention to a letter <br />from Don Houlehan and a map depicting the <br />area. Mr. Larry Mizel, Don Houlehan, and <br />Joe Howard were in attendance. Mr. Houlehan <br />of the law firm DeMuth, Eiberger, Kemp and <br />Backus, stated he represented the C&S RR. <br />The reason for the request at this time was <br />that an agreement had been reached and pre- <br />liminary costs had been worked out with <br />respect to bringing water and sewer lines <br />into the Colorado Technological Center up <br />to Dillon Road. They are being fully planned <br />and installed and costs will be shared by <br />the property owners within the CTC area and <br />the railroad; therefore C&S is anxious to <br />get the annexation of its property completed <br />before the utility lines are installed to <br />serve the entire area. Mayor Waschak asked <br />how soon the railroad anticipated laying <br />the utility lines? Mr. Houlehan replied <br />August 17, 1978 if everything goes according <br />to schedule. <br /> <br />Hr. Larry Mizel, of CTC; at the completion <br />of annexation and zoning, working plans <br />will be started and as soon as the working <br />plans can be developed and bids are out, they <br />plan to physically go forward with the <br />utility lines to Dillon Road and the inter- <br />section of the railroad. Delay over the <br />past 18 months was caused by the railroad <br />wanting to complete the annexation and zoning <br />of all their land before advancing funds <br />necessary to complete the utilities. This <br />expenditure amounts to approximately $400,000. <br />Mr. Mizel stated they do have a written <br />commitment from the railroad for this ex- <br />penditure subject to the annexation. <br />
