Regular Meeting, Louisville City Council, June 6, 1978

ITEMS FROM PEOPLE IN
ATTENDANCE NOT APPEARING
ON THE AGENDA:

CITY ATTORNEY'S REPORT:
RESOLUTION NO. l7-ADOPTING
PERSONNEL CODE

RESOLUTION No. 18
CITY DOCUMENTS

RESOLUTION No. 19
INITIATING ANNEXATION
PROCEDURES FOR PROPERTY
OWNED BY DANAILOFF, KING,
FOSTER, ERBERS & SANTILLI

PAGE 6

There was no one present that wished to
speak.

Attorney Joss read the resolution. Council-
man Gene DiCarlo moved that Resolution No. 17,
Series 1978 be adopted. Seconded by Council-
man Mary DiLorenzo. Question called for.
4 ayes. Opposed none. Motion carried.

Attorney Joss read the resolution in its
entirety. Councilman Meier moved that
Resolution #18, Series 1978 be adopted.
Seconded by Councilman DiCarlo. Question
called for. 4 ayes - opposed none.
Motion carried.

Attorney Joss explained to Council the pro-
ceeding for this anticipated annexation
was unique since 100% of the property owners
were not involved. There was a small tract
of land, less than one acre, that divides
the EBERS property from the FOSTER property.
He had researched the records at Boulder
County and to this time was unable to find
who owned this small tract, even the Title
Company's were uncertain. State Statutes
allow the City to annex the total parcel of
property, but the procedure is different
from other annexations. The resolution pro-
poses our intention to annex this property
and a public hearing be set, publication
notices are different. At the Public Hearing,
Council has to review whether or not the
property is eligible for annexation. This
resolution only indicates that the City
formally accepted the petition to annex the
particular parcel in question and set forth
publicly that Council is willing to proceed
with the necessary hearings and statuatory
procedures to consider the annexation.

Attorney Joss read Resolution #19, Series 1978
in its entirety. Councilman DiCarlo moved
that Resolution No. 19, Series 1978 be adopted
and a Public Hearing be set for July 6, 1978.
Seconded by Councilman Meier. Question called
for. 4 ayes - none opposed. Motion carried.
