RESOLUTION NO. 10 SERIES 2023 A RESOLUTION APPROVING A SITE OPTION AND LEASE AGREEMENT FOR THE ATTACHMENT OF CERTAIN WIRELESS EQUIPMENT TO THE LOUISVILLE RECREATION AND SENIOR CENTER WHEREAS, pursuant to Section 3.04.130(B) of the Louisville Municipal Code, any lease of City property for a term beyond more than one fiscal year must be approved by the City Council by ordinance or resolution, as the City Council shall determine; and WHEREAS, DISH Wireless L.L.C. ("DISH") has requested the right to attach three antennas to the Louisville Recreation and Senior Center roof, and occupy an area of the wall left abandoned by a previous wireless carrier; and WHEREAS, there has been prepared a Site Option and Lease Agreement ("Agreement") to grant DISH such rights in exchange for DISH's payment of rent and other good and valuable consideration, and which contains terms for the protection of the City government and the health, safety, and welfare of the public; and WHEREAS, the City Council by this Resolution desires to approve the Agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. The Site Option and Lease Agreement between the City of Louisville and DISH Wireless L.L.C. ("Agreement"), a copy of which Agreement accompanies this Resolution, is hereby approved. Section 2. The Mayor and City Clerk are hereby authorized to execute the Agreement, and the Mayor is hereby further authorized to negotiate and approve such revisions to the Agreement as the Mayor determines are necessary or desirable for the protection of the City, so long- as the essential terms and conditions of the Agreement are not altered.
