City Council <br />Meeting Minutes <br />September 20, 2022 <br />Page 3 of 11 <br />DEVELOPMENT TO ALLOW CONSTRUCTION OF TWO 33-UNIT MULTI -FAMILY <br />STRUCTURES AND A 1,575 SF COMMERCIAL STRUCTURE, A SPECIAL REVIEW <br />USE TO ALLOW RESIDENTIAL USES ON THE GROUND FLOOR, AND A PLAT <br />FOR THE PROPERTY LOCATED ON THE SOUTHEAST CORNER OF GRIFFITH <br />STREET AND CANNON STREET <br />Mayor Stolzmann introduced the item noting that the public hearing was closed at the <br />last hearing so no additional public comment would take place this evening. <br />Planning Manager Ritchie stated there is no staff presentation, the resolution was <br />prepared based on direction from the last meeting. <br />MOTION: Councilmember Brown moved to approve; Councilmember Leh. <br />VOTE: Motion passed by a roll call vote of 6-1 with Councilmember Dickinson voting no. <br />DISCUSSION/DIRECTION — USE TAX CREDIT PROGRAM <br />Mayor Stolzmann introduced the item. Councilmember Fahey recused herself noting <br />she is one of the residents that would be affected by this program. She left the room. <br />Planning Manager Ritchie reviewed the proposed program. She stated Use Tax is <br />charged on construction materials and collected by the City at the time of building <br />permit. It replaces the collection of sales tax at time of sale of the construction materials <br />and allows the city to retain the funds rather than the jurisdiction where purchase <br />occurs. The program would be available until December 31, 2024 and the credit amount <br />would be proportional to size of the previous home. <br />The draft proposal would be available to property owners who owned the property at the <br />time of the Marshall Fire. She noted staff would like to know if Council is interested in <br />allowing those who lost a different property be allowed to use this on a new property in <br />Louisville. Staff would also like to know if the Council would like this option to also <br />extend to the energy code rules. <br />She noted the City would require the applicant to verify insurance proceeds are not <br />covering payment of the Use Tax. She added that Boulder County Use Taxes are still <br />collected at the time of permit. Applicants can get that rebated through a process with <br />Boulder County. <br />The draft process would include: <br />• Homeowner or builder applies for a permit to reconstruct the home <br />• Property owner shall attest they are requesting the Use Tax Credit due to <br />underinsurance <br />
