She wants the benefit to go to residents not insurance companies. <br />Councilmember Dickinson supports people being allowed to move to a new burn lot with <br />all the same benefits as rebuilding on an existing lot. He also supports the 10% buffer <br />for additional square footage. <br />Mayor Stolzmann stated there is consensus to allow allowing moving between burn lots <br />to get a tax credit and a 10% buffer on the size of the home for the credit. <br />Mayor Stolzmann asked if there is support for a 100% credit if people build to the 2021 <br />IECC (without the appendix), regardless of the square footage. There was support for <br />this from the members. <br />Staff will bring this back an ordinance for consideration. <br />RESOLUTION NO. 38, SERIES 2022 — A RESOLUTION CONDITIONALLY <br />APPROVING A NINE MONTH -LONG TEMPORARY USE AS A PRECURSOR TO A <br />PERMANENT USE TO ALLOW CONSTRUCTION AND OPERATION OF AN <br />OUTDOOR BEER GARDEN ASSOCIATED WITH THE ROCKY MOUNTAIN TAP AND <br />GARDEN LOCATED AT 1077 COURTESY ROAD <br />Mayor Stolzmann introduced the item and asked for disclosures. Councilmember Brown <br />stated he knows the applicant but does not believe it will affect his ability to vote on the <br />item. <br />Mayor Stolzmann opened the public hearing. <br />Planner Kay Marchetti reviewed the application and the relevant codes. She noted a <br />temporary permit as a precursor to a permanent use typically requires the approval of <br />the PUD first, however staff recommends approval to support an existing restaurant. <br />The nine -month time frame is meant to allow enough time for the approval of the PUD <br />amendment. She reviewed the proposed upgrades to the property and some of the <br />existing state of the site. <br />She stated staff finds the application meets the code requirements. It is compatible with <br />the with surrounding area and community facilities; it conforms with applicable <br />requirements; the site can be restored to previous condition if needed. Staff <br />recommends approval with three conditions: the permit shall not be issued until a <br />restoration agreement is finalized; that amplified sound is limited to between the hours <br />of 11 am and 9 pm and that speakers be pointed east, away from nearby residences; <br />and that the applicant submit a revised site plan that includes all of the existing <br />improvements. <br />
