City Council <br />Meeting Minutes <br />October 3, 2022 <br />Page 3 of 8 <br />REGULAR BUSINESS <br />PROCLAMATION — LOUISVILLE, COLORADO ITALIAN-AMERICAN HERITAGE <br />DAY <br />Mayor Pro Tem Maloney read the proclamation. <br />Motion: Councilmember Leh moved to approve, Councilmember Most seconded. <br />Vote: Motion passed by unanimous voice vote <br />ORDINANCE NO. 1841, SERIES 2022 — AN EMERGENCY ORDINANCE <br />EXEMPTING CONSTRUCTION MATERIALS FROM THE CITY'S USE TAX FOR <br />BUILDING PERMITS ISSUED FOR RECONSTRUCTION OF HOMES DAMAGED OR <br />DESTROYED IN THE MARSHALL FIRE BURN AREA — 1st AND FINAL READING — <br />PUBLIC HEARING — Adoption as an Emergency Ordinance <br />Mayor Pro Tern Maloney introduced the ordinance by title and opened the public <br />hearing. <br />Mayor Pro Tern Maloney stated that adopting this as an emergency ordinance is <br />unusual but this was at the request of Council at the September 20 meeting to get this <br />in place as soon as possible <br />Planning Manager Ritchie stated this ordinance comes at the request of Council. She <br />noted that Use Tax is collected by the City at the time of building permit and it is a tax <br />on construction materials. This replaces the collection of sales tax at the time of sale of <br />the materials. This allows the City to keep the tax, rather than the jurisdiction where <br />purchase occurs. <br />As proposed, this ordinance would make a use tax credit available to property owners <br />who owned the property at the time of Marshall Fire. I allows "lot swaps" for property <br />owners who suffered a complete loss on another property affected by Marshall Fire but <br />who buy another fire lot. It would be available until December 31, 2024 and would give a <br />credit amount of 100% of the Use Tax paid for those building to the 2021 IECC code <br />with or without Appendix RC and would give a credit of 110% of the previous house size <br />to those building to the 2018 IECC. <br />Applicants would be required to check a box verifying insurance proceeds are not <br />covering the use tax. She noted the City does still collect the Boulder County portion of <br />the use tax and the applicant would need to apply to the County for that credit. <br />
