City Council <br />Meeting Minutes <br />November 1, 2022 <br />Page 4 of 8 <br />or expansion, reconstruction, or relocation of an existing gasoline service station within <br />2.5 miles of an existing gasoline service station. <br />It is up to the City Council to determine if it wants to adopt the moratorium ordinance <br />and consider whether it should be adopted, as either an emergency or pursuant to its <br />standard ordinance adoption procedure. <br />Mayor Pro Tem Maloney asked if this would affect maintenance issues for existing gas <br />stations. City Attorney Kelly stated they should be able to do maintenance work unless <br />a building permit is required. Director Zuccaro stated that could be amended if Council <br />wants to clarify that something could be reconstructed or rebuilt if a permit is needed. <br />Councilmember Dickinson asked how this would affect any applications that have <br />already been submitted. City Attorney Kelly stated this moratorium would not affect any <br />land use applications already in process. However, it should a new land use application <br />be approved, the corresponding building permit for the project would be subject to the <br />moratorium if this is approved. That could be amended if Council so desires. <br />Mayor Stolzmann asked Dickinson if this moratorium is what he had in mind when he <br />proposed this. Councilmember Dickinson stated that when he proposed it he was <br />concerned about more applications for gas stations coming into the process during the <br />initiative process. He did not have in mind stopping applications already in process. <br />Councilmember Leh asked what the effect of the initiative would be on the pending <br />application. City Attorney Kelly stated it would depend on the timing. If the initiative <br />petition is filed with sufficient signatures it would come to the Council for consideration, <br />but it may not get enough signatures or be filed so it is hard to say what the timing of all <br />that could be and what impact it would have on any active land use applications. <br />Public Comments <br />Jeff Sheets, Koelbel & Company, land owner for the upcoming gas station application, <br />and owner of Centennial Valley properties, asked Council to create a carve out for the <br />existing application that is in process. He noted the process for the application was <br />slowed down significantly due to the Marshall Fire. He stated his concern that is this <br />process is well underway the rules should not be changed at this stage. <br />Katie Doyle Meyers, Louisville, urged Council to approve the moratorium for the <br />betterment of the community and as a way to address climate change and climate <br />justice. She stated she doesn't support more gas stations in the community. She would <br />like the pause in the process to align our planning with our climate goals. <br />Josh Cooperman, Louisville, stated he supports the moratorium as a first step towards a <br />prohibition on new gas stations. He stated new gas station do not help address climate <br />change. Gas stations do nothing to protect and enhance our environment. <br />
