RESOLUTION NO. 13 <br />SERIES 2023 <br />A RESOLUTION APPROVING AN AGREEMENT FOR THE INSTALLATION OF A <br />GOLF BALL TRACKING SYSTEM AT THE COAL CREEK GOLF COURSE <br />WHEREAS, the City desires to approve a Customer Agreement with Topgolf USA, Inc., for <br />the installation of the Toptracer Range golf -ball tracing and entertainment system, consisting of the <br />hardware and the software, at the Coal Creek Golf Course (the "Agreement"); and <br />WHEREAS, the City Council by this Resolution desires to approve the Agreement. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The Toptracer Range Customer Agreement between the City of Louisville and <br />Toptracer USA, Inc. ("Agreement"), a copy of which Agreement accompanies this Resolution, is <br />hereby approved. <br />Section 2. The Mayor and City Clerk are hereby authorized to execute the Agreement, <br />and the Mayor is hereby further authorized to negotiate and approve such revisions to the Agreement <br />as the Mayor determines are necessary or desirable for the protection of the City, so long as the <br />essential terms and conditions of the Agreement are not altered. <br />PASSED AND ADOPTED this 70' day of March, 2023. <br />ATTEST: <br />Meredyth Muth, City Clerk <br />4- <br />SEn <br />Dennis Maloney, May <br />Resolution No. 13, Series 2023 <br />Page 1 of 1 <br />
