It would be up to the <br />applicant when those would be turned on. <br />Mayor Pro Tem Maloney asked if there is enough area for deliveries and access on the <br />lot. Planner Hassan reviewed the site plan and lot; she stated staff feels there is enough <br />room. <br />Councilmember Most asked if the City has the ability to regulate the release of <br />emissions. Planning Director Zuccaro stated the City does not have any authority for <br />emission; those regulations are handled at the State and Federal level. <br />Mayor Stolzmann stated she feels it needs more muted colors to meet the CDDSG <br />requirements. She questioned if the painted metal color meets the CDDSG section <br />4.5.1. She questioned if the stucco -like texture is allowed. Planning Director Zuccaro <br />stated staff feels the amounts in use are not large enough to not comply with the code. <br />Mayor Stolzmann stated it does not feel it complies with the standards. <br />Councilmember Most stated she does not feel the application meets the intent of the <br />Comprehensive Plan and the McCaslin Small Area Plan. She said that given the climate <br />crisis she does not think a gas station that emits carcinogens meets the Comp Plan. <br />She has concerns that approving this will limit redevelopment opportunities in this <br />location and it does not have an appropriate relationship with the surrounding area. She <br />feels the impact of this business is not in line with values of the comprehensive plan. <br />Councilmember Dickinson stated he does not have excitement for this application but it <br />does seem to fit in this spot. He noted it is difficult to align his personal desires related <br />to climate change and his role as a quasi-judicial judge. While he may not see the need <br />for another gas station this application needs to weighed on its merits and the criteria. <br />Councilmember Brown stated he does not think the applicant has met the criteria of the <br />Comprehensive Plan or the Small Area Plan. He noted one of the visions of the <br />Comprehensive Plan is to have sustainable practices for the economy, community, and <br />the environment, and expanding fossil fuel infrastructure is not going to help further <br />those practices. This opens up the City to more environmental impact from gas spills. <br />He stated this application is not consistent with community values or the <br />Comprehensive Plan and he will not support it. <br />Mayor Pro Tern Maloney stated he does not want to implement rules we have not <br />codified. If the Council wants to have a discussion about how to address greenhouse <br />gases, but that would need to be codified so people know what is allowable before they <br />apply. He doesn't want to apply new rules midway through a process. This is an <br />allowable use under the current rules. This Council does clearly support sustainability <br />efforts, but we have to have the rules in place before people apply.
