ORDINANCE NO. 1426 <br /> SERIES OF 2003 <br /> <br /> AN ORDINANCE AUTHORIZING THE ISSUANCE OF CITY <br /> OF LOUISVILLE, COLORADO SALES TAX REFUNDING <br /> REVENUE BONDS, SERIES 2003. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, <br />COLORADO: <br /> <br /> Section 1. Definitions. As used herein, unless the context requires otherwise, <br />the capitalized terms below shall have the following meanings: <br /> <br /> Bond or Bonds: the City's Sales Tax Refunding Revenue Bonds, Series 2003, <br />dated as of October 1, 2003, as authorized by this Ordinance. <br /> <br /> Bond Account: the "City of Louisville, Colorado, Sales Tax Revenue Bonds <br />Account," created in the Refunded Bond Ordinance as a special account of the Capital <br />Improvement Fund for the purpose of paying the principal of, premium, if any, and interest on <br />the Bonds. <br /> <br /> Bond Insurance Policy: the financial guaranty insurance policy issued by the <br />Bond Insurer that guarantees payment when due of the principal of and interest on the Bonds. <br /> <br /> Bond Insurer: Ambac Assurance Corporation, a Wisconsin domiciled stock <br />insurance company, or any successor thereto. <br /> <br /> Bond Registrar or Registrar: U.S. Bank National Association, or its successor, <br />which shall perform the registration, transfer and exchange functions as set forth in this <br />Ordinance and the Paying Agent Agreement. <br /> <br /> Business Day: any day other than a Saturday, Sunday or other day on which <br />banks in Denver, Colorado, are required or authorized to be closed. <br /> <br /> Capital Improvement Fund: a special fund of the City designated as the "City of <br />Louisville Sales Tax Capital Improvement Fund" established by the Sales Tax Ordinance No. <br />981, Series 1989. <br /> <br /> Cede: Cede & Co., the nominee of DTC as record owner of the Bonds or any <br />successor nominee of DTC with respect to the Bonds. <br /> <br /> Charter: the home rule charter of the City, as it may be amended from time to <br /> <br />time. <br /> <br /> <br />
