Ordinance Denied 7-0 <br />December 16, 2003 <br /> <br />ORDINANCE NO. 1434, <br /> SERIES 2003 <br /> <br />AN ORDINANCE APPROVING AN ANNEXATION, KNOWN AS THE STORAGETEK <br />ANNEXATION, TO THE CITY OF LOUISVILLE, COLORADO <br /> <br /> WHEREAS, a petition for annexation of certain unincorporated property, to be known as the <br />StorageTek Annexation, and described in Exhibit A attached hereto, has been filed with the City <br />Council of the City of Louisville; and <br /> <br /> WHEREAS, pursuant to Sections 31-12-108 to - 110, C.R.S., as amended, the City Council <br />has held a duly-noticed public hearing to consider the proposed annexation; and <br /> <br />WHEREAS, notice of such heating was published in the manner provided by law; and <br /> <br /> WHEREAS, the City Council, by resolution, has determined that the petition is in substantial <br />compliance with the applicable laws of the State of Colorado and that the area proposed to be annexed <br />is eligible for annexation; and <br /> <br /> WHEREAS, the City Council further has determined that an election is not required, and has <br />further found that no additional terms and conditions are to be imposed upon said annexation except <br />any provided for in said petition for annexation and in the annexation agreement for the property. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> Section 1. The annexation to the City of Louisville of the property described in Exhibit <br />A, attached hereto and incorporated herein by this reference, and known as the Storage Tek <br />Annexation, is hereby approved and such property is made a part of and annexed to the City of <br />Louisville. <br /> <br /> Section 2. The annexation of said territory is subject to the conditions provided for in the <br />petition for annexation of said property filed with the City of Louisville and to the terms and <br />conditions of the annexation agreement for the property. The annexation of said territory is subject <br />to the condition that the annexation agreement be fully executed and recorded prior to the recording <br />and effectiveness of this annexation ordinance. <br /> <br /> INTRODUCED, READ, PASSED ON FIRST READING, AND ORDERED <br />PUBLISHED this 16th day of December, 2003. <br /> <br /> <br />
