and reenacted, to provide for the following adoptions, modifications, or deletions to the Model <br />Traffic Code adopted by this ordinance, to read as follows: <br /> <br />See. 10.04.020. <br /> <br />Additions or modifications. <br /> <br /> Unless specifically noted as an amendment to Article II, the following <br />additions, amendments and deletions are made to Article I of the Model Traffic <br />Code: <br /> <br /> A. Section 108, Public officers to obey provisions - exceptions for <br />emergency vehicles, subsection (3), is amended to read as follows: <br /> <br /> (3) The exemptions granted in paragraphs (b) to (d) of <br />subsection (2) of this section to an authorized emergency vehicle <br />shall apply only when such vehicle is making use of audible or <br />visual signals meeting the requirements of section 213, and the <br />exemption granted in paragraph (a) of subsection (2) of this section <br />shall apply only when such vehicle is making use of visual signals <br />meeting the requirements of section 213 unless using such visual <br />signals would cause an obstruction to the normal flow of traffic; <br />except that an authorized emergency vehicle being operated as a <br />police vehicle while in actual pursuit of a suspected violator of any <br />provision of this code need not display or make use of audible <br />and/or visual signals so long as such pursuit is being made to <br />obtain verification of or evidence of the guilt of the suspected <br />violator. Nothing in this section shall be construed to require an <br />emergency vehicle to make use of audible signals when such <br />vehicle is not moving, whether or not the vehicle is occupied. <br /> <br /> B. Section 1101, Speed limits, subsections (4) and (7) are deleted, and <br />subsection (2) is amended to read as follows: <br /> <br /> (2) Where speed limits are posted by an official traffic <br />control device, it shall be unlawful for any person to drive any <br />vehicle in excess of the posted speed limits. Where speed limits <br />are not posted, and where no special hazard exists that requires a <br />lower speed, the following speeds shall be lawful: <br /> <br /> (a) Twenty-five (25) miles per hour in any residence <br />district, as defined in Section 42-1-102(80), C.R.S.; <br /> <br /> (b) Thirty (30) miles per hour in any business district, <br />as defined in Section 42-1-102(11), C.R.S.; <br /> <br />2 <br /> <br /> <br />
