ORDINANCE NO. 1853 <br />SERIES 2023 <br />AN ORDINANCE APPROVING AN ELEVENTH AMENDMENT TO THE CENTENNIAL <br />VALLEY GENERAL DEVELOPMENT PLAN'S AMENDED AND RESTATED <br />DEVELOPMENT AGREEMENT TO REVISE PERMITTED USES FOR A PORTION OF <br />PARCEL H AT 972 W DILLON RD <br />WHEREAS, 972 West Dillon Road LLC is the owner of certain real property at 972 <br />W Dillon Road, totaling approximately 1.53 acres, which property is located in Lot 1 B in the <br />Centennial Valley Parcel H, Third Filing subdivision within Parcel H of the Centennial Valley <br />General Development Plan (GDP); and <br />WHEREAS, the Property is currently zoned Planned Community Zone district <br />(PCZD) and, permitted uses are set forth in the Centennial Valley GDP Fifth Amendment to <br />Amended and Restated Development Agreement, executed on July 6, 1995; and <br />WHEREAS, the owner has submitted to the City a request for approval of eleventh <br />amendment to the Centennial Valley Amended and Restated Development Agreement <br />("Eleventh Amendment"), to revise the uses permitted on the Property; and <br />WHEREAS, the Louisville Planning Commission has held a duly noticed public <br />hearing on April 13, 2023 for the proposed amendment and has forwarded a <br />recommendation to the City Council to approve the Eleventh Amendment; and <br />WHEREAS, the City Council has held a duly noticed public hearing on May 16, 2023 <br />for the proposed Eleventh Amendment; and <br />WHEREAS, The Eleventh Amendment is consistent with the requirements of the <br />Planned Community Zone District chapter of the Louisville Municipal Code, and the criteria, <br />requirements, and provisions of other applicable sections of the Louisville Municipal Code, <br />and the principles and polices of the City of Louisville 2013 Comprehensive Plan and the <br />McCaslin Boulevard Small Area Plan; <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The City Council of the City of Louisville hereby approves the Eleventh <br />Amendment to Restated and Amended Development Agreement (the "Eleventh <br />Amendment"), a copy of which is attached hereto as Exhibit A. <br />Section 2.
