NOTICE OF PUBLIC HEARING <br />ORDINANCE No. 1853, SERIES 2023 <br />NOTICE IS HEREBY GIVEN that at a regular meeting of the City <br />Council of the Clty of Louisville, Colorado, to be held on May 16, <br />2023 at the hour of 6:00 pp m., at Louisville City Hall, 749 Main Street, <br />Louisville, Colorado 80027 or in an electronic meeting, the City <br />Council d a Public Hearing on the final assage and adoption <br />VING A <br />MEND - <br />ENT TSoITHEICENTENNIAL VALLEANCE Y GENERAL DEVELOELEVEPMENT <br />AMENDED AND RESTATED DEVELOPMENT AGREEMENT TO RE- <br />VISE PERMITTED USES FOR A PORTION OF PARCEL H AT 972 WEST <br />DILLON ROAD. <br />Published in the Daily Camera on May 7, 2023 with full ordinance. <br />Full copies available In the City Clerk's Office, 749 Main Street, <br />Louisville CO 80027. <br />ORDINANCE NO.1353 <br />SERIES 2023 <br />AN ORDINANCE APPROVING AN ELEVENTH AMENDMENT TO THE <br />CENTENNIAL VALLEY GENERAL DEVELOPMENT PLANS AMENDED <br />AND RESTATED DEVELOPMENT AGREEMENT TO REVISE PERMITTED <br />USES FOR A PORTION OF PARCEL H AT 972 WEST DILLON ROAD <br />WHEREAS, 972 West Dillon Road LLC is the owner of certain re- <br />al property at 972 W Dillon Road, totaling approximately 1.53 acres, <br />which property is located in Lot 1B in the Centennial Valley Parcel <br />H, Third Filing subdivision within Parcel H of the Centennial Valley <br />General Development Plan (GDP); and <br />WHEREAS, the Property is currently zoned Planned Communi- <br />ty Zone district (PCZD) and, permitted uses are set forth in the Cen- <br />tennial Valley GDP Fifth Amendment to Amended and Restated De- <br />velopment Agreement, executed on July 6, 1995: and <br />WHEREAS, the owner has submitted to the City a request for <br />approval of eleventh amendment to the Centennial Valley Amended <br />and Restated Development Agreement ("Eleventh Amendment"), to <br />revise the uses permitted on the Property; and <br />WHEREAS, the Louisville Plannin88 Commission has held a duly <br />noticed public hearing on April 13, 2023 for the proposed amend- <br />ment and has forwarded a recommendation to the City Council to <br />approve the Eleventh Amendment; and <br />WHEREAS, the City Council has held a duly noticed public hear- <br />ing on May 16, 2023 for the proposed Eleventh Amendment; and <br />WHEREAS, The Eleventh Amendment is consistent with the re- <br />quirements of the Planned Community Zone District chapter of the <br />Louisville Municipal Code, and the criteria, requirements, and provi- <br />sions of other applicable sections of the Louisville Municipal Code, <br />and the principles and polices of the City of Louisville 2013 Compre- <br />hensive Plan and the McCaslin Boulevard Small Area Plan; <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF <br />THE CITY OF LOUISVILLE, COLORADO: <br />Section 1. The City Council of the City of Louisville hereby ap- <br />proves the Eleventh Amendment to Restated and Amended Devel- <br />opment Agreement (the "Eleventh Amendment"), a copy of which is <br />attached hereto as Exhibit A, <br />Section 2.
