Board of Adjustment <br />Meeting Minutes <br />July 15, 2009 <br />Page 10 of 12 <br />McCartney acknowledged that staff was unaware of the building code requirement for a <br />stairway landing. <br />Jasiak was satisfied without having any additional information. Jasiak then asked what <br />the code requires for minimum separation between structures. <br />McCartney answered there needs to be 10 feet between structures for fire safety. <br />Applicant Presentation and questions from the Board to the applicant: <br />Peter Pedersen and Julia Rubinsky presented a power point presentation for the Board. <br />Pedersen showed photos of the site with measurements to the deck from various <br />property lines and angles. <br />Pedersen stated they were unaware of the need for a building permit and came to the <br />City immediately after realizing. Pedersen also stated he believed this was the <br />minimum area needed for the stairs. The stairway was added for additional access to <br />the backyard. <br />Questions of Applicant by Board and Staff: <br />None <br />Public Present in Opposition of Application: <br />Robert Pierce, 1728 Eisenhower, spoke in opposition of the request. Pierce stated no <br />other property in the neighborhood had received a variance for their decks and believed <br />the applicant could have built the deck to comply with the PUD requirements. <br />Pierce also stated he believed approval of this variance would alter the character of the <br />neighborhood. <br />Loeblich asked Pierce how he believed the neighborhood would be changed. <br />Pierce stated the deck would be too close to the adjacent property lines. <br />Loeblich asked if Pierce thought this was a public safety issue or more aesthetic. <br />Pierce answered aesthetic. <br />Staff and Applicant Rebuttal: <br />None heard. <br />Public Present in Favor of Application: <br />Chen Chen Shiao, 1767 Eisenhower, spoke in favor of the request. Shiao stated she <br />had no issue with the deck. <br />Questions by the Board: <br />Stuart asked staff if they had checked on permits for other decks in the area. <br />McMillan answered he had not. <br />Jasiak asked how long it took the applicants to build the deck. <br />Pedersen answered it took 2 to 3 weeks. <br />Jasiak asked the applicant how hard it would be for them to move the posts further <br />away from the eastern property line. <br />X:\Planning\Board of Adjustment\2009\BOA.07.15.09.doc <br /> <br />
