Board of Adjustment <br />Meeting Minutes <br />July 15, 2009 <br />City Hall, Council Chambers <br />749 Main Street <br />6:00 <br />PM <br />Call to Order <br /> – Vice Chair Stuart called the meeting to order at 6:05 P.M. <br />Roll Call <br /> was taken and the following members were present: <br />Board Members Present: James Stuart, Vice Chair <br />Erik Jasiak <br />Horst Loeblich <br />Gunnar Malmquist <br />Board Members Absent: Wayne Chancellor, Chair <br />Staff Members Present: Sean McCartney, Principal Planner <br />Gavin McMillan, Planner II <br />Approval of Agenda <br /> – <br />Stuart noted the agenda and requested a motion to approve the agenda. Malmquist <br />moved and Loeblich seconded a motion to approve the agenda. Motion passed by voice <br />vote. <br />Approval of Minutes – <br />May 20, 2009 – Stuart noted the May 20, 2009 minutes and asked if there were any <br />changes. Jasiak stated on page 2, towards the bottom of the page, he wanted the <br />minutes to reflect he recommended City Council to “consider” a change to the LMC for <br />statute of limitation. McCartney agreed to make the change. Stuart requested a motion <br />to approve the minutes as modified. Jasiak moved and Loeblich seconded a motion to <br />approve the minutes. <br />Public Comments <br /> – None heard. <br />Regular Business – Public Hearing Item <br />Case #09-007-VA: <br /> A variance request to encroach 4’ for the covered deck and 6’ for <br />the two story deck into the required 15’ rear yard setback. 888 S. Palisade Ct.; Lot 17, <br />Block 4, Cherrywood. <br />Stuart reviewed the procedures for the meeting; opened the public hearing; and <br />reviewed the criteria which must be met for the variance request. He also stated for the <br />requested variance to be approved a vote of four (4) affirmative would be required.
