Stuart addressed the public to <br />announce the Board will be taking a 5 minute recess. <br />McCartney asked Stuart to consider the time (it was 8:25 p.m.) and reminded the Board <br />that they had two items remaining. Stuart then asked the applicants if they were <br />interested in having their cases heard tonight or would anyone like to continue. Ruth <br />Shoemaker, applicant for Case number 09-006-VA, a variance request to encroach 4’ <br />into the rear yard setback of 15’. 940 Cypress Lane; Lot 46, Cherrywood II, asked to be <br />th <br />continued until the next BOA meeting in August (August 19, 2009). Stuart granted this <br />continuance. <br />The Board then took a 5 minute recess at 8:25 p.m. <br />The Board reconvened at 8:32 p.m. <br />Case #09-005-VA: <br /> Two variance requests: 1) encroach 2’6” into the required 7’ side <br />yard setback on the eastern side and 2) encroach 4’ into the required 25’ rear yard <br />setback. 1748 Eisenhower Dr; Lot 30, Block 1, Ponderosa. <br />Staff Presentation of Facts and Issues: <br />McMillan summarized the staff findings with the following points of discussion: <br /> 1748 Eisenhower Dr, Lot 30, Block 1 of the Ponderosa Subdivision <br /> Request – Variance from the Ponderosa Subdivision Planned Unit Development <br />to reduce the minimum rear yard and side yard setbacks requirement in two <br />separate locations; <br /> Encroach 2’6” into the required 7’ side yard setback on the eastern side. <br />o <br /> Encroach 4’ into the required 25’ rear yard setback. <br />o <br /> Background on the request <br /> The original home at 1746 Eisenhower was constructed in 1986. A <br />o <br />second story deck was located in the rear of the house. Originally, this <br />deck did not have stairs down to the ground level <br />. <br /> The applicants constructed a stairway to the south side of the deck and an <br />o <br />additional landing area on the east side of the deck.
