<br />AUDIENCE COMMENTS <br />ADJOURNED MEETING <br />SCHEDULE <br /> <br />Mr. Keith Helart requested an adjourned <br />meeting with Council to present al al- <br />ternative to a revision of Ordinance <br />#416, and an alternate financing plan <br />for Parks & Recreation. <br /> <br />DENNIS LUNDBERG <br />LURA CHAIRMAN <br /> <br />Mr. Lundberg requested that a date for <br />the C.D. application be scheduled, under <br />an adjourned meeting. The adjourned <br />meeting was scheduled for January 11, <br />1977 at which time the public hearing <br />for the C.D. application will be held. <br /> <br />Councilman DiCarlo moved that the <br />audience comments be accepted and placed <br />on file. Seconded by Councilman <br />Domenico. Motion carried. <br /> <br />CITY ATTORNEY REPORT <br />MAYHOFFER SUIT <br /> <br />Attorney Joss stated that the value of <br />the property involved is $73,025.00, <br />damages $3,500 as found by the commis- <br />sioners. Mr. Wurl noted that it was <br />$14,000 more then was escrowed. <br />Councilman DelPizzo asked if Mrs. May- <br />hoffer was titled the water out of the <br />sewer plant. <br />Mr. Wurl stated that there was an old <br />agreement between her and the sewer <br />district; the water attorneys question it. <br />Mr. Wurl stated that it is the city's <br />position that the agreement is not <br />valid, but nothing is settled as of yet. <br /> <br />PIERCE SUIT <br /> <br />Attorney Joss stated that he talked with <br />Attorney Schroeder who has filed an <br />answer to the complaint and the next <br />step is up to Pierce. Mr. Schroeder <br />is also preparing notices for setting <br />the depositions to take the statements <br />of the plaintiffs and also is requesting <br />written documents which he will send to <br />the City. <br />Attorney Joss stated that if it goes to <br />trial the date will be in about 12 to <br />16 monts. <br /> <br />-2- <br />
