<br />CTC PRELIMINARY PLAT & <br />P.D.D. PLAN <br />PUBLIC HEARING <br /> <br />Mr. Larry Mizel representing the project <br />developer of the CTC stated that he would <br />be glad to answer any questions on the CTC <br />and asked Mr. Donald Houlehan, Attorney <br />for the developer, to reinterate the back- <br />ground on the project. <br />Mr. Houlehan, representing the CTC, stated <br />that the hearing tonight was for request for <br />approval of the preliminary P.U.D. He <br />reviewed the project as follows: <br />Initial contact was made with the City in <br />regards to the development of the CTC. <br />The contact was made informally with the <br />City Administrator and City staff where <br />the overall plan was discussed. <br />Meetings between the City staff and the <br />developer were held; discussion on streets, <br />green areas, etc., were worked out. <br />Negotiations and discussions were at the <br />stage of preliminary plat and development <br />plan was developed by the engineer for <br />the developer. Oblinger/Smith was in- <br />volved as a planning consultant, Sutherland <br />and Assoc., did the surveying along with <br />the City consultant. At this time an <br />annexation agreement was discussed and <br />planned out. <br />Annexation ordinances were prepared by <br />the City Attorney and the initial request <br />and proposal for annexation and zoning <br />were made. At this point, Boulder County <br />began to express interest and recommen- <br />dations concerning the project. The pro- <br />ject then came to the attention of the <br />LUC which then issued various orders to <br />the City putting the matter in Boulder <br />District Court. At that point the law <br />suit with the LUC and Boulder County <br />began in court. It went to the Boulder <br />District Court, Denver District Court and <br />then the Colorado Supreme Court. The Colo. <br />Supreme Court held in favor of Louisville <br />and included that Louisville could not be <br />asked to do anything with the project until <br />annexation was complete. <br />The various ordinances were considered <br />for annexation. <br />There was the 1/6 contiguety present, <br />certain modifications occurred, the annex- <br />ation was complete. It was at that point <br />that the City published and undertook the <br />designation hearings and at which time <br />the hearings were held, the evidence was <br />presented and the Geologic Hazard areas <br />were designated.
